Civil Engineering Design Services Agreement Amendment: Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) (2017 Bond Project)
SUMMARY:
An ordinance approving the execution of an amendment in an increased amount not to exceed $209,554.50 to the $1,537,970.34 Civil Engineering Design Services Agreement with CP&Y, Inc. for additional design services in relation to the Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) Project, a previously authorized debt and 2017 Bond funded project, located in Council District 1. Funds are available from previously authorized debt and 2017 General Obligation Bond funds and are included in FY 2020 - FY 2025 Capital Improvement Program.
BACKGROUND INFORMATION:
Project Background
The Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) is a previously authorized debt and 2017 Bond funded project. This project will provide for the full reconstruction of Commerce Street from St. Mary’s Street to Santa Rosa Street, including wayfinding signage, pedestrian amenities and streetscape improvements as appropriate and within available funding.
Previous Council Action
On October 11, 2012, City Council approved a Civil Engineering Design Services Agreement with CP&Y Inc. in the amount of $812,845.07 for the design and construction phase services for the Downtown Streets Reconstruction: Commerce Street (Street Mary’s Street to Santa Rosa Street) project through Ordinance 2012-10-11-0794. Amendments have increased this contract by $725,125.27 to a total of $1,537,970.34. The proposed amendment will increase the contract by $209,554.50 to a total contract amount of $1,747,524.84.

ISSUE:
This ordinance approves the execution of an amendment in an increased amount not to exceed $209,554.50 to the $1,537,970.34 Civil Engineering Design Services Agreement with CP&Y, Inc. for additional design services in relation to the Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) Project, a previously authorized debt and 2017 Bond funded project, located in Council District 1.
The original design for Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) project was completed in August 2018. In September 2018, a Request for Competitive Sealed Proposal (RFCSP) was advertised for the construction of the project. Responses were received from three construction contractors in December 2018 with proposals ranging from $13.2 million to $16.6 million. In an effort to reduce the cost of the project, the Public Works Department, the design engineer CP&Y and the recommended construction contractor coordinated a value engineering analysis to determine the feasibility of constructing the project within budget. It was determined from the analysis completed the materials proposed needed to be re-evaluated requiring the streetscape to be re-designed to accommodate for the proposed new materials and provide continuity among the other projects within the Zona Cultural District.
This amendment will compensate CP&Y for the additional design services provided to complete the design of Commerce Street (St. Mary’s Street to Santa Rosa Street). Upon approval, the design is anticipated to be completed in May 2020.
ALTERNATIVES:
As an alternative, City Council could choose not to approve these additional design services, and recommend the solicitation of these services. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project and result in the potential loss of design continuity and coordination efforts invested with other projects within the Zona Cultural District.
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount not to exceed $209,554.50 payable to CP&Y, Inc. to provide additional engineering services related to the Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street. to Santa Rosa Street) Project. Funds are available from previously authorized debt and 2017 General Obligation Bond funds and are included in FY 2020 - FY 2025 Capital Improvement Program.
RECOMMENDATION:
Staff recommends approval of an amendment in an increased amount not to exceed $209,554.50 to Civil Engineering Design Services Agreement with CP&Y, Inc. for additional design services related to Downtown Streets Reconstruction: Commerce Street (St. Mary’s Street to Santa Rosa Street) Project.
