Amendments to the Residential Noise Program Contracts at San Antonio International Airport
 
 
SUMMARY:
 
These Ordinances authorize amendments to the professional services agreements with THC, Inc. and Foster CM Group, Inc. in connection with the Residential Acoustical Treatment Program at San Antonio International Airport.  The FAA contributes 80% to this program with the City providing a 20% match.
 
A.      An Ordinance authorizing an amendment to the contract with THC in the amount of $7,260,000.00 for on-going construction of acoustical treatments to reduce noise in qualifying homes and multi-family dwellings in aviation noise-impacted neighborhoods near the Airport.
B.      An Ordinance authorizing an amendment to the contract with Foster CM Group in the amount of $440,000.00 for design review, construction inspection and testing services for the Program.
 
BACKGROUND INFORMATION:
 
The Residential Acoustical Treatment Program (RATP) is an ongoing, multi-year program that provides acoustical treatment to reduce noise in qualifying homes and multi-family dwellings in aviation noise-impacted neighborhoods near the San Antonio International Airport. The RATP is a derivative of the noise compatibility studies and is consistent with federal guidelines and requirements mandated in the Federal Aviation Administration (FAA) grant assurances.
 
The program is based on the design-build model and the single parcel method where each dwelling is treated as a separate project. These practices ensure program efficiency, accountability and maximize property owner satisfaction. The program is cyclical in nature. The renovation of one group of residences is in process while the next group is under design.
 
Under the contract with the City, THC, Inc. provides a team of sub-consultants and design-build construction contractors, and the resources necessary to implement the Program, including the construction contracting effort and processing sub-consultant and construction contractor payments.
 
Owners of eligible dwellings meet each of the construction contractors that have been pre-qualified by THC to participate in the program. THC contracts for design services for each dwelling separately. Property owners select three construction contractors to prepare and submit bids. THC awards the contract.
 
Since the program began on July 24, 2006, 1,216 single-family and duplex-type homes and 216 individual apartments have received acoustical treatment.
 
Previous Council Action
A. On April 2, 2009, City Council awarded a professional services agreement in the amount of $8,000,000.00 to THC. Subsequent amendments have been approved by City Council (Ordinances 2009-04-02-0245, 2010-09-16-0805, 2011-09-29-0798, 2012-03-29-0233 and 2012-12-06-0943). The contract is set to expire on April 17, 2015.
 
B. On December 10, 2009, City Council awarded a professional services agreement in the amount of $1,500,000.00 to Foster CM Group, Inc. through Ordinances 2009-12-10-1004, 2012-03-29-0234 and 2012-12-06-0944. The contract is set to expire on December 31, 2014.
 
These contract amounts are aligned with the grants received each fiscal year by the Federal Aviation Administration. These contract amounts will allow the continuation of the Program for the next fiscal year.
 
ISSUE:
 
The first ordinance will approve an amendment for THC for continued management of the Program. The second amendment will approve an amendment with Foster for continued design review, construction inspection and testing services.
 
 
ALTERNATIVES:
 
City Council could direct staff to issue new Request for Qualifications to seek interest from other firms. Such action would result in the need to halt the Program and resume it again after the new solicitation processes are completed and two new contracts awarded which delay may have a negative impact on FAA grant funds previously accepted.
 
 
FISCAL IMPACT:
 
The Program is funded with FAA Airport Improvement Program grant funds at 80% and 2010 Passenger Facility Charge bonds for the City's matching 20%. Funds for this project have been previously appropriated and are captured under the approved Airport Capital Budget. Sufficient funds are available for this action.
 
 
RECOMMENDATION:
 
Staff recommends the authorization of the amendments with approval of the amendments to the two professional services agreement with THC, Inc. and Foster CM Group, in connection with the Residential Acoustical Treatment Program.
