Developer Participation Agreement: UTSA Boulevard and Hausman Road

 

 

SUMMARY:

 

An ordinance authorizing the execution of a Developer Participation Agreement between the City of San Antonio and UTSA Blvd IH 10 LP, a Texas Limited Partnership in an amount not to exceed $2,100,000.00 for the construction of a north-south connector between UTSA Boulevard and Hausman Road, located in Council District 8.

 

 

BACKGROUND INFORMATION:

 

As part of the FY 2018 Budget, $2,100,000 was approved for construction of a north-south connector between UTSA Boulevard and Hausman Road within the Schumacher Tract.  This project will include street work, drainage improvements, and traffic signals, as well as widening at UTSA Boulevard and the addition of a left turn lane on Hausman Road.  The project will create 12-foot lanes in each direction as well as a 4-foot sidewalk on one side of the roadway and a 10-foot sidewalk on the other which is wide enough to serve as a shared-use path and can accommodate both bicyclists and pedestrians at the same time. This project will provide connectivity in the area to accommodate current and anticipated development in the area.

 

Hausman Road was widened and reconstructed through the 2012-2017 Bond Program.    UTSA Boulevard, from Babcock Road to IH-10 was reconstructed as two projects, one overseen by the City and one overseen by TxDOT.  Hausman Road and UTSA Boulevard both run east-west, with the major connections being Babcock Road and IH-10.  This project will provide additional north-south connectivity between Hausman Road and UTSA Boulevard.

 

This agreement is in compliance with the Texas Local Code, Sections 212.071 - 212.074, which allows municipalities to enter into a contract with a developer for the construction of public improvements related to a development.  The State Code limits the participation by the municipality not to exceed 30% of the total contract price or not to exceed 100% of the total cost for the oversizing of improvements required by the municipality, including, but not limited to increased capacity of improvements to anticipate other future development in the area.  This Agreement stipulates the City’s portion is not to exceed 100% of the cost for the oversizing.

 

 

The oversizing the City will fund include street work, concrete curbs, sidewalks, storm drain, traffic signals, and utility extensions necessary to meet anticipated future development.  The total cost for the project is $5,369.710, with the City’s portion for the oversizing of $2,100,000 and the Developer’s portion of $3,269,710.

 

The City will continuously monitor the project from initial construction documents through routine site visits and pay request approvals.   The City’s $2,100,000 will be provided on a reimbursement basis via the City’s approval of payment requests by the developer as the project progresses. 

 

Procurement of Services

This agreement will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 22% Minority/Women Business Enterprise (M/WBE) subcontracting goal, and a 1% African American Business Enterprise (AABE) subcontracting goal.

    

                                                                              

ISSUE:

 

This ordinance authorizes the execution of a Developer Participation Agreement with UTSA Blvd IH 10 LP, a Texas Limited Partnership in an amount not to exceed $2,100,000 for the construction of a north-south connector between Hausman Road and UTSA Boulevard, located in Council District 8.

 

UTSA Blvd IH 10 LP, a Texas Limited Partnership will ensure the completion of the engineering and construction of the project which includes the construction of a north-south connector between Hausman Road and UTSA Boulevard, as well as drainage improvements and traffic signals.  The project will create 12-foot lanes in each direction as well as a 4-foot sidewalk on one side of the roadway and a 10-foot sidewalk on the other which is wide enough to serve as a shared-use path and can accommodate both bicyclists and pedestrians at the same time.

 

 

ALTERNATIVES:

 

City Council could choose not to approve this Developer Participation Agreement; however doing so would cost the City a willing partner for the delivery of this needed project. 

 

 

FISCAL IMPACT:

 

This ordinance authorizes a one-time capital improvement expenditure in an amount not to exceed $2,100,000 payable to UTSA Blvd IH 10 LP, a Texas Limited Partnership. Funds in the amount of $2,100,000 are available from FY 2018 Certificates of Obligation and are included in the FY 2018-2023 Capital Improvements Program.

 

 

RECOMMENDATION:

 

Staff recommends the approval of a Developer Participation Agreement with UTSA Blvd IH 10 LP, a Texas Limited Partnership, in an amount not to exceed $2,100,000.
