SUMMARY:
An ordinance, for the construction of Hardy Oak - Stone Oak Parkway to Knights Cross, accepting the lowest responsive bid and awarding a construction contract, including two (2) additive alternates, in the amount of $3,317,277.86, of these amount $73,998.95 will be reimbursed by SAWS Water and $70,481.18 will be reimbursed by CPS, to DNT Construction LLC, a 2012 Bond funded Project, located in Council District 9.
BACKGROUND INFORMATION:
Project Background
The 2012-2017 General Obligation Bond Program authorized $8,800,000.00 for funding of the Hardy Oak Blvd and of that, $3,317,277.86 will be used for construction. The balance of the Project funds approved by voters will be used for design services, environmental services, advertising and project management, with any remaining funds to be realized as bond savings.
This Project provides for the construction of approximately one half mile of a new four-lane divided roadway from Stone Oak Parkway to Knights Cross with shared use paths, sidewalks, driveway approaches, curbs, traffic signal, and drainage improvements, as needed.  Currently, there is no roadway in the area today.  This section is part of the Major Thoroughfare Plan and will provide connectivity between Stone Oak Parkway to Sonterra.  A Public Meeting was held on November 13, 2013 with the Stone Oak POA and a separate meeting was held for the Ridge at Stone Oak HOA.  On September 10, 2014, a second Public Meeting was held with the Stone Oak POA.  Project construction is anticipated to begin November 2014 and estimated to be completed by August 2015 and construction will be Monday thru Friday from 7:00 AM to 4:00 PM.
Procurement of Services
An Invitation for bids was advertised in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, and through the TCI Small Business Office in August 2014. In addition, plans were available for review by potential bidders at the office of Vickrey & Associates, Inc., located at 12940 Country Parkway, San Antonio, Texas 78216.  Bids for this Project were opened on September 2, 2014 and four (4) bidders responded.  Of these, DNT Construction LLC submitted the lowest responsive bid.  A matrix of the bid outcome is included herein as Attachment 2.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal.  DNT Construction LLC has committed to 25.9% M/WBE subcontractor participation.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
ISSUE:
This ordinance accepts the lowest responsive bid and awards a construction contract, including two (2) additive alternates, in the amount of $3,317,277.86, of which $73,998.95 will be reimbursed by SAWS and $70,481.18 will be reimbursed by CPS Energy, authorized payable to DNT Construction LLC for construction of Hardy Oak - Stone Oak Parkway to Knights Cross, a 2012 Bond funded Project, located in Council District 9.
 
This contract provides for construction of approximately one half mile of a new four-lane divided roadway from Stone Oak Parkway to Knights Cross with 10-ft shared use paths on one side of the road, a 6-ft sidewalk on the other side of the road, driveway approaches, curbs, traffic signal, and drainage improvements as needed throughout the project.  The two (2) additive alternates included as part of this contract include the option to install slope stabilization along the roadway, as determined in the field at the time of construction; and the installation of landscape irrigation within the median.  Project construction is anticipated to begin in November 2014 and is estimated to be completed by August 2015.
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2012 Bond funded projects.
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project.  
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $3,317,277.86 authorized payable to DNT Construction LLC, of this amount $73,998.95 will be reimbursed by SAWS and $70,481.18 will be reimbursed by CPS Energy.  Funds are available from the 2012-2017 General Obligation Bonds and are included in the FY 2015 - 2020 Capital Improvement Budget.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $3,317,277.86, authorized payable to DNT Construction LLC, for construction of Hardy Oak - Stone Oak Parkway to Knights Cross.
