Contract Award: Gilbert Garza Park Improvements Project
 
 
SUMMARY:
An ordinance accepting the lowest responsive bid and awarding a construction contract, for construction of the Gilbert Garza Park Improvements Project, including two (2) additive alternates, in the amount of $318,058.00, to ASD Consultants, Inc.; a 2007 and 2012 General Obligation Bond funded Project, located in Council District 7.
 
BACKGROUND INFORMATION:
Project Background
On May 12, 2012, San Antonio voters approved the 2012-2017 Bond Program, consisting of five propositions totaling $596 Million.  The Bond Program funds will be used on various capital improvement projects to address community infrastructure needs and improve the overall quality of life in San Antonio.  As part of the Parks, Recreation and Open Space Improvements Bond Program, funds in the total amount of $500,000.00 were approved for park improvements at Gilbert Garza Park located in Council District 7. In additional to the construction contract, the project budget has been utilized for design services, environmental services, and project management.
 
This Project provides for the reconfiguration and rehabilitation of the existing parking lot as well as parking lot expansion and associated sidewalk and landscape upgrades.  Project construction is anticipated to begin June 2014 and estimated to be completed by October 2014.  Coordination with the Gilbert Garza Community Center and Parks and Recreation Department will be made to ensure accommodations are done to minimize service interruptions and/or accessibility to the Park during construction.
 
Procurement of Services
This Project was advertised for construction bids in the San Antonio Hart Beat, on the City's website and the Texas Electronic State Business Daily in February 2014.  In addition, the bid announcement was made on TVSA and through the Small Business Economic Development Advocacy (SBEDA) Office.  Plans were also available to potential bidders at the office of Rehler Vaughn and Koone, Inc. located at 745 E. Mulberry Ave., San Antonio TX 78212. Bids for this project were opened on March 25, 2014 and seven (7) bidders responded. Of these, ASD Consultants, Inc. submitted the lowest responsive bid.  A matrix of the bid outcome is included herein.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 20% Small Business Enterprise (SBE) subcontracting goal and a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal.  ASD Consultants, Inc. has committed to 30.05% SBE subcontractor participation and 30.05% M/WBE subcontractor participation.  ASD Consultants, Inc. is also a certified African American owned business (AABE), bringing total proposed SBE and AABE participation to 100%.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
ISSUE:
This ordinance accepts the lowest responsive bid and awards a construction contract, including two (2) additive alternates, in the amount of $318,058.00, authorized payable to ASD Consultants, Inc., for construction of the Gilbert Garza Park Improvements Project, a 2007 and 2012 General Obligation Bond funded Project, located in Council District 7.
 
This contract provides for the reconfiguration and rehabilitation of the existing parking lot as well as parking lot expansion and associated sidewalk and landscape upgrades.  The two (2) additive alternates identified as part of this contract allow for repairs to the existing asphalt walking trail and the construction of a concrete pad which is expected to receive installation of an artwork by Public Art San Antonio (PASA), funded by previously approved 2007 General Obligation Bond funds.  Funds were budgeted as part of 2007 Culebra 58F Drainage Bond Project for the design and installation of a concrete pad on which the PASA Bond Art project would be fabricated and an artwork would be installed.  The concrete pad was designed to be installed in the channel.  Unfortunately, due US Army Corp of Engineering's permit requirements the location of the concrete pad within the channel was not feasible.  Cooperative efforts between TCI and PASA were made to identify a visible and adjacent location to complete the PASA Bond Art Project component.  The adjacent Gilbert Garza Park, a voter approved 2012 Bond Project, was identified as the most cost effective and logistical location to complete the PASA Bond Art component.  Project construction is anticipated to begin in June 2014 and is estimated to be completed by October 2014.
 
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2007 and 2012 Bond funded projects.
 
 
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the project and funding.  
 
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $318,058.00 authorized payable to ASD Consultants, Inc.  Funds in the amount of $12,800.00 in 2007 General Obligation Bond funds and $305,258.00 in 2012 General Obligation Bond funds are available and included in the FY 2014 - FY 2019 Capital Improvement Program.
 
 
RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $318,058.00, authorized payable to ASD Consultants, Inc., for construction of the Gilbert Garza Park Improvements Project.
