Task Order Construction Contract for Federally Funded Projects
 
 
SUMMARY:
 
This ordinance accepts the lowest responsive bid and awards the Task Order Construction Contract for Federally Funded Projects to FD Concrete, LLC, for an amount not to exceed $1,674,052.00 for the construction of various projects that have received federal funding, located throughout the City.
 
BACKGROUND INFORMATION:
 
Project Background
Throughout the year, the City is awarded funds to complete various projects through the use of federal funds. In FY 2014 and FY 2015 the City allocated $2,430,000.00 in Community Development Block Grants (CDBG) to complete an array of public infrastructure improvements in the REnewSA Target Areas.  In order to facilitate the completion of these construction projects, the Transportation and Capital Improvements Department (TCI) solicited bids for construction services and is recommending the use of FD Concrete, LLC to complete these projects. Federally funded projects must be kept separate from other City contracts because the City's SBEDA policy conflicts with federal law.
 
 
This contract was advertised for construction bids in November 2014, in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA and through the TCI Small Business Office. Bids were due on Tuesday, December 17, 2014, and eight (8) bidders responded. FD Concrete, LLC was the lowest responsive bidder with a bid amount of $1,674,052.00.  The balance of federal funds will be used for design and inspection.
 
This contract will be awarded in compliance with the City of San Antonio's Housing and Urban Development's Section 3 program which requires economic opportunities be directed to low-income persons and businesses. The Office of Grants Monitoring and Administration will review and approve a Section 3 Utilization Plan submitted by the Respondent prior to the commencement of contract activity, as required by HUD 108 funding requirements. Reporting of actual activity will be required on a monthly basis until project completion.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
 
ISSUE:
 
This ordinance accepts the lowest responsive bid and awards the Task Order Contract for Federally Funded construction Projects to FD Concrete, LLC, for an amount not to exceed $1,674,052.00 for the construction of various projects that have received federal funding, located throughout the City.
The Task Order Contract for Federally Funded Projects will be utilized primarily to complete projects that already have received federal funding.  However, this contract also may be used to construct other federally funded projects that materialize throughout the contract term.   
 
Potential funding sources for individual work orders include, but are not limited to, Community Development Block Grants/HUB 108 (REnew SA Strategic Catalytic projects and EastPoint Promise Zone projects), Federal Highway Administration (FHWA) and other potential federal funding sources.
 
 
ALTERNATIVES:
 
An alternative to utilizing an outside contractor to complete these projects would be to use in-house staff.  However, due to in-house staff's existing workload completing the projects identified in the FY 2015 through FY 2019 Adopted Infrastructure Improvement Program, completing these construction projects would not be possible.
 
TCI staff, in review of potential alternatives, has determined that awarding FD Concrete the Task Order Contract for Federally Funded Projects is in the best interest of the City, in order to expedite project delivery and ensure timely completion.
 
 
 
FISCAL IMPACT:
 
This is a $1.6 million contract. Funds have been budgeted in the FY 2014 and FY 2015 Budget for this work. Funding sources for individual work orders include, but are not limited to, Community Development Block Grants/HUD 108 (REnew SA Strategic Catalytic projects and EastPoint Promise Zone projects), Federal Highway Administration (FHWA) and other potential federal funding sources.
 
 
Requirements for each task shall be detailed in the individual work orders assigned.  If funding for any work activities was not previously appropriated, funding will be identified and appropriated through subsequent City Council action.  
 
 
RECOMMENDATION:
 
Staff recommends the approval of this ordinance awarding the Task Order Contract for Federally Funded Projects to FD Concrete, LLC in an amount not to exceed $1,674,052.00.
