SUBJECT:
Donation, Development Agreement and Job Order Contract (Task Order): Maverick Park (2017 Bond Project)
SUMMARY:
Consideration of the following items related to Maverick Park, a Downtown Parks 2017 Bond funded project, located in Council District 1:
A. An ordinance approving the acceptance and appropriation of a donation from the San Antonio Parks Foundation in an amount not to exceed $100,000.00 for the construction of park improvements at Maverick Park.
B. An ordinance approving a First Amendment to the Development Agreement between the San Antonio Parks Foundation and the Midtown Board of Directors of Reinvestment Zone #31, granting an additional $110,000.00, for a total up to $160,000.00 in reimbursable funds from the Midtown Tax Increment Reinvestment Zone (TIRZ) #31 fund; and, authorizing the appropriation and amending of the FY 2020 - 2025 Capital Improvements Program Budget with these funds for the construction of park improvements at Maverick Park.
C. An ordinance approving a task order to a Job Order Contract with Amstar, Inc., in an amount not to exceed $639,844.00 for the construction of park improvements for Maverick Park.
BACKGROUND INFORMATION:
Project Background
On May 6, 2017, voters approved the 2017 Bond Program which authorized $1,250,000.00 for improvements to the Downtown Parks Package. This package included four park locations: Maverick Park, Milam Park, Travis Park and Columbus Park. The Maverick Park project will provide for the construction of a fenced-in dog park with associated amenities such as sidewalks, lighting, drinking fountains, landscape planting and associated park furniture (to include benches and tables), as well as a new restroom structure and associated utilities. Construction is anticipated to begin in May 2020 and is estimated to be completed by November 2020.
The San Antonio Parks Foundation is a 501(c)(3) nonprofit organization that supports enhancements to the parks of the City of San Antonio and Bexar County. The Foundation was organized in 1981 and works closely with the City of San Antonio’s Departments of Parks and Recreation and Downtown Operations in addition to Bexar County. The Foundation is donating funding in the amount of $100,000.00 to the City for the construction of improvements to Maverick Park.
Previous Committee Action
On September 13, 2019, the Midtown TIRZ Board of Directors approved a Resolution (attached) authorizing the execution of the First Amendment to Funding Agreement with Midtown TIRZ Board to provide available tax increment funding in the additional amount of $110,000.00 for a total amount not to exceed $160,000.00 for construction of improvements for Maverick Park.
Procurement of Services
The task order associated with this project utilizes Job Order Contracting (JOC), an alternative project delivery method in which ten contractors were approved through Ordinance 2019-02-21-0134 by City Council on February 21, 2019. The use of the JOC delivery method provides the City with on-call construction, renovation and maintenance services for City buildings and facilities. Assignment of JOC contractors to specific jobs is based on the contractor’s current workload, overall capacity and familiarity with a specific facility, expertise in completing specific task and/or managing a specific trade needed to carry out the requested repair or rehabilitation. Of the ten contractors, Amstar, Inc. was selected to submit an estimate and project schedule for this project.
This task order will be executed in compliance with the Small Business Economic Development Advocacy (SBEDA) Program requirements awarded with the JOC, which the Goal Setting Committee set a 24% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 4% African American Business Enterprise subcontracting goal. Amstar, Inc. has committed to a 24% M/WBE and 4% AABE subcontractor participation.
The Discretionary Contracts Disclosure Form, as required by the City’s Ethics Ordinance for all Projects where subjective criteria are used to select the contractor or consultant rather than by low bid, is attached.
ISSUE:
Consideration of the following items related to the Maverick Park - Downtown Parks Project, a 2017 Bond funded project, located in Council District 1:
A. This ordinance approves the acceptance and appropriation of a donation from the San Antonio Parks Foundation in an amount not to exceed $100,000.00 for the construction of park improvements at Maverick Park.
The acceptance of the donated funds is necessary to ensure full funding of all of the associated community requested scope items for Maverick Park, a Downtown Parks 2017 Bond funded project. Maverick Park will be funded by voter approved 2017 General Obligation Bond funds and a $100,000.00 from the San Antonio Parks Foundation.
B. This ordinance approves a First Amendment to the Development Agreement between the San Antonio Parks Foundation and the Midtown Board of Directors of Reinvestment Zone #31, granting an additional $110,000.00, for a total up to $160,000.00 in reimbursable funds from the Midtown Tax Increment Reinvestment Zone (TIRZ) #31 fund; and, authorizes the appropriation and amending of the FY 2020 - 2025 Capital Improvements Program Budget with these funds for the construction of park improvements at Maverick Park.
Chapter 311 of the Property Tax Code authorizes the municipality that designated a TIRZ to enter into agreements and construct public improvements necessary for the development and revitalization projects that benefit the City and Midtown TIRZ. On September 13, 2019, the Midtown TIRZ Board of Directors approved a Resolution (attached) authorizing the execution of the First Amendment to Funding Agreement with Midtown TIRZ Board to provide available tax increment funding in the total amount not to exceed $160,000.00 for construction of improvements for Maverick Park.
C. This ordinance approves a task order to a Job Order Contract with Amstar, Inc., in an amount not to exceed $639,844.00 for the construction of park improvements to Maverick Park.
The project will provide for the construction of a fenced-in dog park with associated amenities such as walks, lighting, drinking fountains, landscape planting and park furniture, as well as a new restroom structure and associated utilities. Construction is anticipated to begin May 2020 and estimated to be completed by November 2020. Maverick Park will remain open during construction.
ALTERNATIVES:
A. City Council could choose not to accept the donated dollars; however, without the San Antonio Parks Foundation as a partner, the City would not have enough funding to construct the entire project or complete the project within the same timeline.
B. As an alternative, City Council could choose not to approve this funding agreement; however, without the acceptance of the funding from the Midtown TIRZ the proposed improvements related to dog park for the project will not be constructed.
C. As an alternative, this project could be delivered utilizing another delivery method. However, considering the additional time required for the solicitation process, this would adversely affect the timely completion and contractor flexibility on the project.
FISCAL IMPACT:
A. This ordinance approves a donation and acceptance of funds in the amount of $100,000.00 from the San Antonio Parks Foundation for construction of improvements at Maverick Park.
B. Funding for the proposed dog park as part of the 2017 Bond Downtown Maverick Park project is from the Midtown Tax Increment Reinvestments Zone (TIRZ) #31 fund, granting an additional $110,000.00 for a total of up to $160,000.00 in reimbursable funds from the TIRZ #31 fund. This ordinance approves the appropriation of these funds and amends the FY 2020-2025 Capital Improvements Program with funds in the amount not to exceed $160,000.00 from Midtown Tax Increment Reinvestment Zone (TIRZ) #31 fund for the Downtown Maverick Park Project.
C. This is a one-time capital improvement expenditure in an amount of $639,844.00, authorized payable to Amstar, Inc. Funds in the amount of $379,844.00 are available from 2017 General Obligation Bond Program and are included in the FY 2020 - 2025 Capital Improvement Program Budget.
RECOMMENDATION:
A. Staff recommends approval of this ordinance authorizing a donation and acceptance of funds in the amount of $100,000.00 from the San Antonio Parks Foundation for construction at Maverick Park.
B. Staff recommends approval of this ordinance authorizing a First Amendment to the Development Agreement with the Midtown Board of Directors of Reinvestment Zone #31, granting an additional $110,000.00, for a total of up to $160,000.00 in reimbursable Midtown Tax Increment Reinvestment Zone (TIRZ) #31 funds for construction at Maverick Park.
