Design-Build Contract Amendment for Hausman Road (Loop 1604 to IH10)
 
 
SUMMARY:
 
An ordinance to fully fund the construction budgeted for a portion of Huesta Creek: Bamberger Park to UTSA Project, a Proposition 2 (2010) Sales Tax Initiative Funded Project, authorizing an amendment in the increased total amount not to exceed $389,876.35 to the $71,588,000.00 Design-Build Services Agreement with Sundt Construction, Inc., for construction services for the Hausman Road (Loop 1604 to IH10) Project, a 2012-2017 General Obligation Bond-funded project, both projects are located in Council District 8.  
 
BACKGROUND INFORMATION:
 
Project Background
 
As part of Linear Creekway Park trails program, the Parks and Recreation Department identified the area of Huesta Creek crossing Hausman Road as a location of a 10-foot wide greenway trail segment approximately 1.1 mile in length. This trail will provide connectivity and accessibility to the Howard W. Peak Greenway System for nearby residents. As the proposed trail is within the Hausman Road Project boundaries, staff considers it prudent that Design-Builder Sundt Construction complete this additional work so the trail project will be well coordinated with the Hausman Road Project.
 
The Hausman Road (Loop 1604 to IH10) Project was included in the 2012-2017 Bond Program.  The Project provides for the reconstruction and widening of Hausman Road from Loop 1604 to IH 10 including curbs, sidewalks, bike lanes, a 10 foot shared-use path on the southside, traffic signals and drainage improvements.  The Project also includes two Bexar County flood control projects (Low water Crossing 9 and 10), located within the limits of the City's Hausman Road Project. These projects will replace low water crossings with bridges along Hausman Road, from Huntsman to Roadrunner Way and will include channel improvements to Huesta Creek and Maverick Creek.  Utility construction on the Project began in December 2013 and is estimated to be completed in December 2015.
 
 
Previous Council Action
A previously executed contract with Sundt Construction, Inc. in the amount of $62,000,000.00 was approved by City Council on November 15, 2012, through Ordinance 2012-11-15-0897.  A previous amendment to compensate the Design-Build team for the additional design, anticipated construction costs and include the Huesta Creek Trail system was approved on June 5, 2014 through Ordinance 2014-06-05-0385.   The June 5, 2014 Amendments and one other amendment for the actual road construction have increased this contract by $9,588,000.00 to a total of $71,588,000.00.  This amendment will increase the contract by $389,876.35 to a total contract amount of $71,977,876.35.

ISSUE:
 
The Design-Builder Sundt Construction reviewed the preliminary construction plans for the Huesta Creek Trails and provided an estimated construction cost of $968,000.00 in early 2014.  This amount was included in the amendment approved by City Council June 5, 2014.  As the consultant finalized the Huesta Creek Trail plans, Sundt Construction reviewed the final plans and was able to provide a more refined construction cost in the amount of $1,354,829.35.  The difference in cost between Sundt Construction's final cost estimate and preliminary cost estimate is $389,876.35, which will be added to the contract through a contract amendment through this council action.  
 
This amendment will allow for the construction of these items. Approval of the ordinance will be a continuation of City Council policy to complete previously approved Sales Tax projects.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to approve this amendment; however, that would adversely affect the timely completion of the Hausman Road (Loop 1604 to IH 10) Project. Furthermore, re-advertising the project would not guarantee an experienced or as qualified consultant as Sundt Construction, Inc. who has worked on all prior project design phases and is working on the construction.
 
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the total amount not to exceed $389,876.35, payable to Sundt Construction, Inc. to provide construction services in the Huesta Creek Project, creating a 10-foot wide greenway trail segment approximately 1.1 mile in length. Funds are available from Proposition 2 Sales Tax Funds and are included in the FY 2015-2020 Capital Improvement Program Budget.
 
 
RECOMMENDATION:
 
Staff recommends approval of this amendment in the amount of $389,876.35 to the Sundt Construction, Inc. Design-Build Service Agreement for the Hausman Road (Loop 1604 to IH 10) Project.
