SUBJECT:
Full Purpose Annexation of the South San Antonio Area 1, Area 2, Area 3, and Area 4; and the adoption of the Service Plan.
SUMMARY:
An Ordinance providing for the extension of the City of San Antonio limits by the Full Purpose Annexation of approximately 19.62 square miles of land known as the South San Antonio Annexation Area 1, Area 2, Area 3, and Area 4, generally located south of Loop 410, between Old Pearsall Road and State Highway 181, and establishing an effective date of December 31, 2016, and adopting a Service Plan for the area. BACKGROUND INFORMATION:
The South San Antonio Areas 1, 2, 3 and 4 encompass approximately 12,558 acres or 19.62 square miles. On January 9, 2014, the City Council of San Antonio approved Ordinance #2014-01-09-0001, which annexed for Limited Purposes the South San Antonio Areas 1 - 4, pursuant to Chapter 43 of the Texas Local Government Code. These areas were annexed for "limited purposes" with the effective date of January 19, 2014 and were scheduled for "full purpose" annexation within three years of the effective date of limited purpose annexation.
The Limited Purpose Annexation allowed the City to extend regulatory authority to apply its planning, zoning, health, and safety ordinances without the provisions of full services. Under Limited Purpose Annexation the City did not assess property taxes. The three-year period between Limited Purpose Annexation and Full Purpose Annexation afforded the City time to further study full-purpose annexation potential, plan for the orderly extension of full municipal services to the area, and to provide a framework for capital improvements planning for the area.
The City of San Antonio developed a Service Plan and made it available pursuant to Chapter 43 of the Texas Local Government Code. The City will provide full municipal services as required and defined by the Texas Local Government Code. The City reserves the right guaranteed to it by the Texas Local Government Code, to amend this Plan if the City Council determines that changed conditions or subsequent occurrence or any other legally sufficient circumstances exist under the Local Government Code, or other Texas laws to make this Plan unworkable, obsolete, or unlawful.
ISSUE:
The zoning districts assigned during Limited Purpose Annexation that currently exist will be adopted and assigned to the subject properties upon Full Purpose Annexation. Under Full Purpose Annexation the City of San Antonio will enforce all ordinances, provide services as required by law, and assesses property and sales tax. Annexation of the subject property will provide a uniform level of City services for the area therefore, avoiding the difficulties associated with multi-jurisdictional public safety boundaries. Once the subject properties are annexed into San Antonio, they would benefit from standardized full City services protecting health, safety and well-being as described in the Service Plan. The proposed annexation will expand San Antonio’s municipal boundaries, the public service area, and the Annexation Service Plan addresses the public services to be implemented.
State law requires that the municipality follow certain provisions for annexation, including the publication of the public hearing notification, two public hearings by the governing body and the adoption of the annexation ordinance and "Service Plan." In addition, the City Charter requires consideration by the Planning Commission, and the publication of the annexation ordinance 30 days prior to the final adoption. The effective date of annexation will be December 31, 2016.
The four areas would receive public safety services from the already existing San Antonio Police Department South Patrol Station located at 711 Mayfield and from Fire Station #50 located at 12703 Applewhite Road. Fire Station #52, located at 10440 Quintana Road and Fire Station #53, located at 14102 Donop Road will provide services upon the effective date of annexation.
ALTERNATIVES:
If the City Council elects not to annex an area for Full Purposes, the properties would revert back to Limited Purpose.
FISCAL IMPACT:
The cost for 2 new fire stations for the South San Antonio Annexation Areas 1, 2, 3, and 4 is approximately $3.1 million. The initial staffing and equipment costs will be $1.233 million, which includes a new medic unit located at Fire Station #50. Annual recurring costs for both stations are estimated at $4.575 million.
RECOMMENDATION:
Staff recommends the approval of an Ordinance providing for the extension of the City of San Antonio limits by the Full Purpose Annexation of approximately 19.62 square miles of land known as the South San Antonio Annexation Area 1, Area 2, Area 3, and Area 4, generally located south of Loop 410, between Old Pearsall Road and State Highway 181, and establishing an effective date of December 31, 2016, and adopting a Service Plan for the area.
