Contract Award: Belford Area Drainage
SUMMARY:
An ordinance for Belford Area Drainage project, a 2012-2017 Bond-funded Project, located in Council District 3, awarding a construction contract, including two additive alternates, to Jordan Foster Construction in the amount of $6,249,080.75, of which $372,649.25 will be reimbursed by San Antonio Water Systems (SAWS) and $185,400.00 will be reimbursed by CPS Energy and accepting $50,000.00 from Legacy Brooks, LTD through a Developer Fund Agreement.
BACKGROUND INFORMATION:
On May 12, 2012, voters approved the 2012 - 2017 Bond Program which authorized $8,000,000.00 for the Belford Area Drainage Project. On May 19, 2011 City Council approved the reallocation of approximately $47 million in the 2007 - 2012 Bond Program savings. Included in this reallocation was $1.85 million for the Belford Area Drainage Project.
Project Background
The Belford Area Drainage Project resulted from a drainage study, funded by the 2007 Bond Savings, of the existing drainage conditions in the Belford Area located in the Fairlawn drainage watershed (adjacent to Highland Hills). The study area was bounded by IH-37 and SE Military Drive to the south, Pecan Valley Drive to the west and natural ridges to the north and east. The results of the study were summarized in a Preliminary Engineering Report (PER) on how to alleviate localized flooding which flood Belford Drive and the Belford-Upotia intersection. The results identified drainage improvements, including an underground storm sewer system and street improvements throughout the Belford Area.
The base bid of the Belford Area Drainage Project provides for the reconstruction of Belford Drive from Utopia Lane to Palfrey Drive, Utopia Lane from Belford Drive to 665-feet west of Belford and the construction of an open, earthen channel ranging in width from 60-ft to 70-ft wide from the Belford-Utopia intersection to IH-37. The first additive alternate of work provides for the reconstruction of Belford Drive from Palfrey Drive to the midblock of Gale Avenue & Banbridge Avenue. The second additive alternate of work provides for the reconstruction of Belford Drive from the midblock of Gale Avenue & Banbridge Avenue to Galway Drive.
This ordinance also accepts $50,000.00 from a Developer Fund Agreement with Legacy Brooks, LTD. The agreement is a result of the City approaching the developer for a drainage easement to improve the existing channel. The developer offered $50,000.00 as a contribution to revise the alignment of the drainage easement in order to accommodate future development.
A community meeting was held on March 27, 2014, to gain neighborhood input. Coordination with the businesses and local residents will be made to maintain accessibility during construction and accommodations, such as providing temporary driveway access to residential and commercial properties and phasing the construction work to minimize traffic inconveniences to the traveling public, will be completed as required.
Procurement of Services
This Project was advertised for construction bids in June 2015 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA and through the TCI Small Business Office. Plans also were available for review by potential bidders at the office of Freese and Nichols, Inc., 4040 Broadway, Ste. 600, San Antonio, Texas, 78209. Bids for this Project were opened on July 21, 2015 and seven bidders responded. Of these, Jordan Foster Construction submitted the lowest responsive bid. A summary of the bid outcome is included as an attachment.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 17% Minority/Women Business Enterprise (M/WBE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by Jordan Foster Construction because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses. In addition, Jordan Foster Construction is a certified small business.
ISSUE:
This Ordinance for the Belford Area Drainage project awards a construction contract including two additive alternates to Jordan Foster Construction in the amount of $6,249,080.75, of which $372,649.25 will be reimbursed by San Antonio Water Systems and $185,400.00 will be reimbursed by CPS Energy and accepts $50,000.00 from Legacy Brooks, LTD through a Developer Fund Agreement, a 2012-2017 Bond-funded Project located in Council District 3.
This project consists of the reconstruction the Belford Area Drainage Project with curbs, sidewalks, driveway approaches, underground drainage and an open channel to outfall at IH-37. Project construction is anticipated to begin in October 2015 and estimated to be completed by October 2016. Construction activities will take place six days a week, sunrise to sunset.
This ordinance also accepts $50,000.00 from a Developer Fund Agreement with Legacy Brooks, LTD. The agreement is a result of the City approaching the developer for a drainage easement to improve the existing channel. The developer offered $50,000.00 as a contribution to revise the alignment of the drainage easement in order to accommodate future development.
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of this Project.
If City Council chooses to not reallocate the Capital Budget for the base bid and additive alternates, then the project will have to be re-advertised.
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $6,249,080.75, payable to Jordan Foster Construction. Of this amount, $372,649.25 will be reimbursed by SAWS and $185,400.00 will be reimbursed by CPS. Funds are available from the 2012-2017 General Obligation Bond, 2007 Bond Savings and are included in the FY 2015-2020 Capital Improvement Budget. This ordinance also accepts funds in the amount of $50,000.00 from Legacy Brooks, LTD. through a Developer Fund Agreement.
RECOMMENDATION:
Staff recommends approval of this ordinance awarding a construction contract in the amount of $6,249,080.75, payable to Jordan Foster Construction, for construction of the Belford Area Drainage Project and the acceptance of $50,000.00 from Legacy Brooks, LTD. through a Developer Fund Agreement.
