SUBJECT:

 

Real Estate Acquisition:  Southcross Boulevard (I-37 to I-35) (2017 Bond Project)

 

 

SUMMARY:

 

An ordinance authorizing the acquisition through negotiation or condemnation of interests in land sufficient for project purposes involving 20 parcels of privately-owned real property totaling 0.1618 acres (6,883 square feet) located along Southcross Boulevard between Pleasanton Road and Mission Road in New City Blocks 7702, 7704, 7707, 7710, 7711, 7809, 7810 and 7813 in Council District 3 for the Southcross Boulevard (I-37 to I-35) Project, a 2017 Bond project; declaring it to be a public use project and a public necessity for the acquisition. 

 

The 20 parcels of land located in the City of San Antonio, Bexar County, Texas to acquire are identified as follows:

Pursuant to enacted Texas Senate Bill (SB18), this item requires City Council to initiate a motion authorizing the use of power of eminent domain, should it be needed.

 

 

BACKGROUND INFORMATION:

 

On May 6, 2017, voters approved the 2017 Bond Program authorizing $5,000,000.00 for the Southcross Boulevard (I-37 to I-35) project.  This project will provide for the construction of corridor improvements including curbs, sidewalks and driveway approaches and traffic signal upgrades at the Mission Road intersection.    

 

The project consists of 150 parcels of land acquisition, of which 20 have not been acquired.  The acquisitions are slivers of property from the existing right-of-way to widen existing sidewalks.  The acquisition of the 20 parcels of land is necessary for the completion of the project.  Construction is anticipated to begin in March 2021 and estimated to be completed in March 2022.

 

 

ISSUE:

 

This ordinance authorizes the acquisition through negotiation or condemnation of interests in land sufficient for project purposes involving 20 parcels of privately-owned real property totaling 0.1618 acres (6,883 square feet) located along Southcross Boulevard between Pleasanton Road and Mission Road in New City Blocks 7702, 7704, 7707, 7710, 7711, 7809, 7810 and 7813 in Council District 3 for the Southcross Boulevard (I-37 to I-35)  Project, a 2017 Bond project; declaring it to be a public use project and a public necessity for the acquisition. 

 

The acquisition of 20 of the 150 parcels of land is necessary for the completion of the Southcross Boulevard (I-37 to I-35) project. 

 

The City intends to use every effort available to obtain the required property through good faith negotiations with the property owners but may require eminent domain if the negotiations are not successful.  Approval of this ordinance declares this project as a public project and allows staff, if necessary, to exercise its power of eminent domain (condemning property) as declared under Article I, Section 17 of the Texas Constitution and Texas Local Government Code.

 

 

ALTERNATIVES:

 

City Council could choose not to authorize the acquisition of privately-owned real property for this project; however, this would not allow for the completion of pedestrian improvements as part of the project.

 

 

FISCAL IMPACT:

 

The fair market value for the total of 20 parcels of land is an amount not to exceed $56,306.00 as determined by independent appraisers.  Funds are available from the 2017 - 2022 General Obligation Bond Program and are included in the FY 2021 - FY 2026 Capital Improvement Program.

 

 

RECOMMENDATION:

 

Staff recommends approval of the ordinance authorizing the acquisition through negotiation or condemnation of interests in land sufficient for project purposes involving 20 parcels of privately-owned real property for the Southcross Boulevard (I-37 to I-35) project, a 2017 Bond project; declaring it to be a public project and a public necessity for the acquisition.
