SUBJECT:

 

A reconfiguring of land located in and adjacent to Hemisfair and Hemisfair Parkland

 

 

SUMMARY:

 

An ordinance to adjust property lines within Hemisfair to add parkland and facilitate P3 development. Transfers to dedicated parkland total 0.719 acres and include the following: 0.383 acres of abandoned Market Street ROW and 0.336 acres of land formerly deeded to Hemisfair Park Public Facilities Corporation (HPPFC). Conveyances to the HPPFC total 0.7435 acres and include the following: 0.656 acres of abandoned Market Street ROW and 0.0875 acres of former public right of way along South Alamo Street. The final conveyance is from HPPFC to City totaling 0.060 acres. All land is located in or adjacent to Hemisfair in Council District 1. This action also authorizes a second amendment to the Master Lease Agreement and Master Agreement to reflect these transactions.

 

 

BACKGROUND INFORMATION:

 

Hemisfair Park Area Redevelopment Corporation (HPARC) was established on August 13, 2009 to manage and oversee the planning, development, construction, managing, and financing of projects within Hemisfair. On February 9, 2012, City Council approved the Hemisfair Master

Plan to restore connectivity and revitalize the area into a vibrant, urban parks district with multiple uses.

 

On December 5, 2013, City Council passed and approved a dedication of 18.47 acres of public parkland within Hemisfair consisting of six tracts of land known as Hemisfair Parkland.

 

On December 18, 2013, the City conveyed 14.15 acres of land through seven tracts of land situated Hemisfair to the Hemisfair Park Public Facility Corporation (PFC) to develop a series of Public-Private Partnerships (P3s) with real estate developers in accordance with the Hemisfair Master Plan.

 

On February 24, 2016 the Planning Commission approved City of San Antonio Transfer of Ownership of five parcels of property totaling 3.218 acres adjacent to the Hemisfair Park Public Facility Corporation PFC Tracts 1, 4, 5a, 7a, and 8 and dedicated 0.276 acres to dedicated Hemisfair Parkland.

 

On November 18, 2016 the Planning Commission took the following actions:

 

1.                     Transfers to dedicated parkland total 0.719 acres, including 0.383 acres of abandoned Market Street ROW and 0.336 acres of land formerly deeded to Hemisfair Park Public Facilities Corporation (HPPFC);

 

2.                     Conveyances to the HPPFC a total of 0.7435 acres that include 0.656 acres of abandoned Market Street ROW and 0.0875 acres of former public right of way along South Alamo Street.

 

3.   Conveyance from HPPFC to City a total 0.060 acres.

 

The PFC Tracts and Parkland Tracts are depicted in Attachment I.

 

 

ISSUE:

 

While several tracts of land were intended to be incorporated into the PFC tracts and Hemisfair Parkland tracts, they were not previously ready to be conveyed and dedicated.  Additionally, to expedite the platting effort in the northwest zone of Hemisfair in support of the second P3 development and civic park project, HPARC requires a portion of property previously conveyed to the PFC to be conveyed back to the City.

 

As such, HPARC is requesting the City

 

1.                     close, vacate, and abandon 0.0875 acres of public right of way
along South Alamo St. and then convey the 0.0875 acres of land to PFC for the Northwest Zone P3 as PFC Tract 2A.  (Attachment II)

 

2.                     convey 0.656 acres of land from the former Market Street right of way to the PFC for the Northwest Zone P3 as PFC Tract 1A (Attachment III)


3. 
                     dedicate to the public through a Deed of Dedication a parcel consisting of

0.276 acres of land from the former Market Street right of way which was

previously closed, vacated and abandoned to Parkland Tract 1A for the Civic Park (Attachment IV);

 

4.                     dedicate to the public through a Deed of Dedication 0.107 acres of land out of former Market Street right of way which was previously closed, vacated, and abandoned to a Hemisfair Parkland Tract 7 for the Civic Park (Attachment V);


5.
                     accept 0.336 acres of land out of PFC Tract 2 and then dedicate the 0.336

acres of land to the public through a Deed of Dedication Hemisfair Park Tract 8 for the Civic Park (Attachment VI); and


6.
                     convey 0.060 acres of land out of PFC Tract 2 to the City of San

Antonio for future lease opportunities.  (Attachment VII)

 

The above mentioned transactions increase the amount of dedicated parkland from 18.47 acres to 19.19 acres in Hemisfair.  Additionally, HPARC requests a second amendment to the Master Agreement, acknowledging the changes to the development and park property, as well as a second amendment to Master Lease Agreement to exclude the property conveyed back to the City and to include the new tracts conveyed by the City to the PFC.

 

 

ALTERNATIVES:

 

City Council could choose not to convey one or more of the tracts; however, disapproval of any part of the conveyance would negatively impact the overall Hemisfair development and cause delays to the Civic Park and P3 developments.

 

 

FISCAL IMPACT:

 

This Ordinance will transfer responsibility for maintenance of the subject tracts to the Hemisfair PFC and HPARC with the exception of .396 acres of PFC Tract 2 which will be conveyed back to the City.

 

The City will not receive revenues from the conveyances of property.

 

 

RECOMMENDATION:

 

Staff recommends the following land transactions:

 

1.                     An ordinance closing, vacating, and abandoning 0.0875 acres of public right of way along South Alamo Street;

 

2.                     Accepting real property by the City of San Antonio consisting of a total of 0.396 acres of property;

 

3.                     Dedicating three parcels of real property consisting of a total of 0.719 acres of property as Hemisfair Parkland;

 

4.                     Conveying two parcels to the Hemisfair PFC totaling 0.7435 acres, located in or adjacent to Hemisfair in Council District 1;

 

5.                     Authorizing an amendment to the Master Lease Agreement and Master Agreement to reflect as such.
