Contract Award: FY 2015 - FY 2016 Curb Ramp Indefinite Delivery Contract
 
 
 
SUMMARY:
 
This ordinance approves an Indefinite Delivery construction contract (also known as a Task Order Contract) with FD Concrete, LLC, for an amount not to exceed $683,777.00 for the construction of Americans with Disabilities Act (ADA) compliant curb ramps and related sidewalk improvements across the City, in conjunction with the Street Maintenance Program (SMP), a major component of the Infrastructure Management Program (IMP). Of this amount, San Antonio Water Systems (SAWS) will reimburse approximately $31,000.00 for necessary adjustments to its existing infrastructure.
 
 
BACKGROUND INFORMATION:
 
San Antonio's Sidewalk Transition Plan (Plan) was adopted in 2008. The Plan's mission is to provide a walkable community of sidewalks and crosswalks that are ADA compliant and available to all citizens. City staff from various departments, people with disabilities and ADA community advocates assessed the current policies and practices, reviewed the Plan's goals and established objectives and tasks. A key component of the Plan is its goal to provide sidewalk access ramps for access to sidewalks when a street is "altered". Furthermore, sidewalk access ramp construction is a requirement set forth by the Americans with Disabilities Act of 1990 annotated in Title II, Subpart D; Program Accessibility.  According to this federal requirement, curb ramps are required to be installed as part of a street project when a street is newly constructed or altered.
 
All ADA compliant curb ramps are planned to be completed as part of the scope for Asphalt Overlay Projects that are to be constructed with in-house forces, scheduled through the FY 2015 - 2016 IMP. This provides the flexibility to execute the construction of the curb ramps for the FY 2015 and FY 2016 SMP, while the in-house forces concentrate on the asphalt portion of the projects.
 
 
This Contract was advertised for construction bids in the Hart Beat, on TVSA, the City's Web site, the Electronic State Business Daily and through the TCI Small Business Office in June 2014. Bids for this contract were opened on July 29, 2014, with three (3) bidders responding. FD Concrete was the lowest responsive bidder with a bid amount of $683,777.00.  A matrix of the bid outcome is included herein.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 12% Small Business Enterprise (SBE) subcontracting goal and a 6% Minority/Women Business Enterprise (M/WBE) subcontracting goal. FD Concrete, LLC has committed to 12% SBE subcontractor participation and 6% M/WBE subcontractor participation.
 
This construction contract was developed utilizing the formal competitive bid process, therefore, a Discretionary Contracts Disclosure Form is not required.
 
An indefinite delivery contract (also known as a task order contract) allows the Department to handle multiple projects that are to be delivered through various programs and funding sources using standard unit pricing. These contracts are awarded based on the capacity, or total dollar amount, anticipated to deliver a number of projects within a specified timeframe. No minimum level of work is guaranteed on an indefinite delivery contract and the contractor is paid for work performed under issued task orders.
 
 
ISSUE:
 
This ordinance authorizes an indefinite delivery construction contract with FD Concrete, LLC, for an amount not to exceed $683,777.00, for the construction of sidewalk access ramps and related sidewalk improvements across the City, in conjunction with the Street Maintenance Program (SMP), a major component of the Infrastructure Management Program (IMP). The construction of these curb ramps is in compliance with the Sidewalk Transition Plan and the Americans with Disabilities Act of 1990 annotated in Title II, Subpart D; Program Accessibility and will be funded by the Advanced transportation District (ATD) Fund. In addition, San Antonio Water Systems (SAWS) will reimburse approximately $31,000.00 for necessary adjustments to its existing infrastructure.
 
 
ALTERNATIVES:
 
An alternative to construction of sidewalk access ramps through this contract is to have in-house staff construct the ADA sidewalk access ramps. However, the Department does not have the capacity to handle the volume of sidewalk access ramps that are contemplated to be completed through this contractor.
 
 
FISCAL IMPACT:
 
This contract in an amount not to exceed $683,777.00 will be used to construct several ADA accessible curb ramps throughout the City for projects identified in the FY 2015 - 2016 IMP, along with additional projects that may materialize throughout the contract term.  Projects will be funded through various funding sources which may include, but is not limited to, Advanced Transportation District (ATD), General Fund and Neighborhood Access and Mobility Program (NAMP). Additional work activities will be allocated in the form of task orders as funding is made available.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsible bid and awarding the FY 2015 - FY 2016 Curb Ramp Indefinite Delivery Construction Contract to FD Concrete, LLC in an amount not to exceed $683,777.00.
