Real Estate Disposition:  Sale of City owned property located near Broadway Street and Tesoro Drive

 

 

SUMMARY:

 

An ordinance declaring as surplus an unimproved parcel of land located near Broadway Street and Tesoro Drive, in Council District 10 and authorizing its sale to the North East Independent School District (NEISD) for a total of $550.00.

 

 

BACKGROUND INFORMATION:

 

Under Municipal Code, all city property must be declared as surplus prior to the disposition of the property.  The request to declare property as surplus must be submitted to the Department of Transportation & Capital Improvements, Real Estate Division, then the request and exhibits are sent to departments and municipal utilities that provide services to, or construct infrastructure on the properties.  The departments and municipal utilities respond if there is a need for the property or if the property can be disposed of. 

 

North East Independent School District (NEISD), Petitioner, is requesting that the City of San Antonio declare as surplus and sell an unimproved 0.092 of an acre (4,007 sq. ft.) tract of City owned land located adjacent to their administrative offices at 8961 Tesoro Drive.  As shown on attached Exhibit A, the parcel is landlocked by a 40 foot drainage channel and an “L” shaped, unimproved alley.  The subject parcel has not been used and over the years, has become overgrown with vegetation and low lying tree branches.  NEISD would like to create and maintain the area as green space with tables and chairs, for use as a lunch/break area by its employees and visitors; thereby, making it a functional and regularly used parcel of land.

 

 

ISSUE:

 

This ordinance will declare as surplus an unimproved 0.092 of an acre (4,007 sq. ft.) tract of City owned land located near Broadway Street and Tesoro Drive, in Council District 10 and authorize its sale to the North East Independent School District for a total of $550.00.

This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property.

 

 

ALTERNATIVES:

 

City Council could choose not to approve this request; however, that would disallow NEISD from utilizing and creating a functional and regularly used space.  Additionally, the City would continue to be responsible for maintenance costs until the property can be sold.

 

 

FISCAL IMPACT:

 

According to the City staff appraisal of the property using Bexar County Appraisal District information, the property is valued at $14,000.00. The property was listed on Multiple Listing Service (MLS) for sale and the only offer received was from the Petitioner. The City of San Antonio and the purchaser have agreed on a sale price of $550.00. The City of San Antonio will collect the money and deposit the proceeds into the General Fund in accordance with the FY 2018 Adopted Budget. Since the purchaser of the land is a school district and a City partner with the Pre-K 4 SA program and since the property is an awkward, land-locked site, City staff is recommending the sale in the amount of $550.00.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance to declare as surplus and sell City-owned real property located near Broadway Street and Tesoro Drive, in Council District 10, to NEISD for a total of $550.00.

 

The City of San Antonio’s Planning Commission approved this request at its regular meeting on February 14, 2018.
