Contract Awards for delivery of Sidewalk Program
SUMMARY:
These ordinances award three Task Order contracts for the construction of sidewalk and pedestrian-related projects, to facilitate the completion of projects identified in the FY 2015 through FY 2019 Infrastructure Management Program (IMP), adopted through the Budget process on September 18, 2014:
a) An ordinance accepting the lowest responsive bid and awarding the 2015-2016 Flatwork Task Order Contract, Package 13, in an amount not to exceed $4,152,777.00, to FD Concrete, LLC. Of this amount, $40,650.00 is to be reimbursed by San Antonio Water Systems for necessary adjustments to its existing infrastructure.
b) An ordinance accepting the lowest responsive bid and awarding the 2015-2016 Flatwork Task Order Contract, Package 14, in an amount not to exceed $2,404,094.45, to San Antonio Concepts Construction, LLC. Of this amount, $16,250.00 is to be reimbursed by San Antonio Water Systems for necessary adjustments to its existing infrastructure.
c) An ordinance accepting the lowest responsive bid and awarding the 2015-2016 Flatwork Task Order Contract, Package 15, in an amount not to exceed $2,288,087.50, to Austin Constructors LLC. Of this amount, $8,875.00 is to be reimbursed by San Antonio Water Systems for necessary adjustments to its existing infrastructure.
BACKGROUND INFORMATION:
Project Background
During the FY 2015 Budget process, City Council identified $8.4 million in Advanced Transportation District (ATD) funds to complete numerous sidewalk and pedestrian related projects. As part of the department's continuing efforts to expedite project delivery and completion of sidewalk and pedestrian-related projects citywide, the Transportation and Capital Improvements Department has solicited bids for construction services and will be utilizing various construction companies to complete the construction of several sidewalk related projects.
These Task Order Contracts for Flatwork Projects includes, but is not limited to, the construction of sidewalks, curbs, wheelchair ramps, retaining walls and any other work required for the completion of the assigned projects located throughout the City. SAWS participation on these contracts is necessary in order to complete adjustments to their existing infrastructure that impact City project. SAWS will reimburse their improvement cost to the City of San Antonio based on the bid unit prices per this construction contract.
A task order contract is utilized when multiple projects are to be delivered, through various programs and funding sources, in a limited timeline but the project specifics (scope and limits) are not known. A task order contract is awarded based on the capacity, or total dollar amount, anticipated to deliver a number of projects within a specified limited timeframe. Funding for these projects may include, but is not limited to, Advanced Transportation District (ATD), General Fund, Neighborhood Access and Mobility Program (NAMP), or other funding sources.
Procurement History
a) The 2015 - 2016 Flatwork Task Order Contract - Package 13 was advertised for construction bids in August 2014, in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA and through the TCI Small Business Office. Bids were due on September 16, 2014 and eight bidders responded. FD Concrete, LLC was the lowest responsive bidder with a bid amount of $4,152,777.00.
The 2015 - 2016 Flatwork Task Order Contract - Package 13 will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 13% Minority/Women Business Enterprise (M/WBE) subcontracting goal, and a 1% African American Business Enterprise (AABE) Subcontracting Goal. F.D. Concrete, LLC has committed to 13% M/WBE subcontractor participation and 1% AABE subcontractor participation.

ISSUE:
These ordinances award three Task Order contracts for the construction of sidewalk and pedestrian-related projects, to facilitate the completion of projects identified in the FY 2015 through FY 2019 Infrastructure Management Program (IMP). During the FY 2015 Budget process, City Council identified $8.4 million in Advanced Transportation District (ATD) funds to complete numerous sidewalk and pedestrian-related projects. These contracts will be utilized to ensure the timely completion of those projects along with any other sidewalk projects that materialize throughout the duration of these contracts:
a) An ordinance accepting the lowest responsive bid and awarding the 2015-2016 Flatwork Task Order Contract, Package 13, in an amount not to exceed $4,152,777.00, to FD Concrete, LLC. Of this amount, $40,650.00 is to be reimbursed by San Antonio Water Systems for necessary adjustments to its existing infrastructure.

ALTERNATIVES:
An alternative would be to individually bid out the projects for construction. However, construction bid prices could be higher than those estimated with the Task Order Contract and bidding the projects individually would prolong the delivery of these projects.
Another alternative to construction of these projects by these contractors is to utilize TCI in-house staff. However, with the demands of completing the Infrastructure Management Program (IMP), the Department does not have the capacity to handle the volume of projects that are contemplated to be completed by the task order contractor.
FISCAL IMPACT:
These contracts have a total capacity of $8,844,958.95. Funding will come from prior approved and budgeted funds including $8,400,000.00 in Advanced Transportation District (ATD) Sidewalk Program and $2,000,000.00 in the General Fund Neighborhood Access and Mobility Program (NAMP), or other funding sources such as Capital Improvement Program funds.
Requirements for each task shall be detailed in the individual work orders assigned. If funding for any work activities is not previously appropriated, funding will be identified and appropriated through subsequent City Council action. In addition, up to $65,775.00 will be reimbursed to the City by San Antonio Water Systems as projects are identified.
RECOMMENDATION:
Staff recommends approval of these ordinances awarding the following task order contracts necessary to complete sidewalk related projects identified in the FY 2015 through FY 2019 Infrastructure Management Program:
a) 2015-2016 Flatwork Task Order Contract, Package 13 to F. D Concrete, LLC, in an amount not to exceed $4,152,777.00.
b) 2015-2016 Flatwork Task Order Contract, Package 14 to San Antonio Concepts Construction, LLC, in an amount not to exceed $2,404,094.45.
c) 2015-2016 Flatwork Task Order Contract, Package 15 to Austin Constructors, LLC, in an amount not to exceed $2,288,087.50.
These construction contracts were developed utilizing the formal competitive bid process. Therefore, a Discretionary Contracts Disclosure Form is not required.
