Design-Build Contract Amendment for Hausman Road (Loop 1604 to IH 10)
SUMMARY:
An ordinance authorizing an amendment in the increased total amount not to exceed $9,568,000.00 to the $62,000,000.00 Design-Build Services Agreement with Sundt Construction, Inc. for design and construction services for the Hausman Road (Loop 1604 to IH 10) Project, a 2007 and 2012 General Obligation Bond funded project, located in Council District 8. Of this total amendment amount, $4,800,000.00 will be reimbursed by San Antonio Water System and $800,000.00 will be reimbursed by CPS Energy. This ordinance also adjusts the spending plan to accelerate FY 2015 allocated Linear Creekway Park Trails Program funds in amount of $910,000.00 to FY 2014, for the construction of the Huesta Creek Greenway trail.
BACKGROUND INFORMATION:
Project Background
The Hausman Road (Loop 1604 to IH 10) Project is a 2012 - 2017 General Obligation Bond funded Project that provides for the reconstruction and widening of Hausman Road from Loop 1604 to IH 10 including curbs, sidewalks, bike lanes, a 10 foot shared-use path on the southside, traffic signals and drainage improvements. The Project also includes two Bexar County flood control projects (Low water Crossing 9 and 10), located within the project limits of the City's Hausman Road Project. These projects will replace low water crossings with bridges along Hausman Road from Huntsman to Roadrunner Way and will include channel improvements to Huesta Creek and Maverick Creek. Project construction began in Spring 2014 and is estimated to be completed in Fall 2015.
Previous Council Action
On November 17, 2011 City Council approved, through Ordinance 2011-11-17-0941, a professional civil engineering services contract with Civil Engineering Consultants to provide a schematic of the Hausman Road Project (Loop 1604 to IH 10) to be used in the development of the formal design and scoping of the Project to be completed as part of 2012 Bond.
A previously executed a Design-Build contract with Sundt Construction, Inc. in the amount of $62,000,000.00 was approved by City Council on November 15, 2012, through Ordinance 2012-11-15-0897. Amendments have increased this contract by $20,000.00 to a total of $62,020,000.00. This amendment will increase the contract by $9,568,000.00 to a contract amount of $71,588,000.00.

ISSUE:
The original Design Build Services Agreement with Sundt Construction, Inc. in the amount not to exceed $62,000,000.00 was based on initial project scope and two year-old construction estimates. As the design had been completed, the scope has been refined resulting in more accurate construction cost estimates. Those costs include $3,000,000.00, for additional rock excavation, material and equipment cost escalation, storm damage and cleanup for channel construction, and off-duty police officers for traffic control; and, $5,600,000.00 for associated utility work for a total design and construction estimate of $8,600,000.00. Of this total amount $3,000,000.00 will be City's portion, $4,800,000.00 will be reimbursed by San Antonio Water System and $800,000.00 will be reimbursed by CPS Energy. This amendment will compensate the Design-Build team for the additional design and anticipated construction costs related to Hausman Road Project. Funds are available from the Project's budgeted contingency.

Huesta Creek Greenway Trail
As part of Linear Creekway Park trails program, funded by Proposition 2 Sales Tax Initiative (2010), the Parks and Recreation Department identified the Huesta Creek area as a future location of a greenway trail segment approximately 1.1 miles in length. This trail will provide connectivity and accessibility to the Howard W. Peak Greenway System for nearby residents. Given that the proposed trail is within the Hausman Road Project boundaries, staff is requesting that Design-Builder Sundt Construction complete this work so the roadway, drainage and trail projects will be well coordinated and to create efficiencies in time and project costs. The estimated construction cost of the trail is $968,000.00. Of the $968,000.00 from Huesta Creek Trail. $58,000.00 is available in the Linear Creekway Park Trails Program. The remaining $910,000.00 is in the Linear Creekway Park Trails Program Spending Plan for FY 2015. This ordinance adjusts the spending plan by accelerating the FY 2015 allocated amount to FY 2014.
This amendment will compensate the Design-Builder for the construction of Huesta Creek Greenway trail. Funds for this additional scope of work requested by the City will be provided by Linear Creekway Park trails program and has been listed in the FY 2014-2019 Capital Improvements Plan.
Approval of the ordinance will be a continuation of City Council policy to complete previously approved 2012-2017 General Obligation Bond funded projects.
ALTERNATIVES:
As an alternative, City Council could choose not to approve this amendment; however, that would adversely affect the timely completion of the Hausman Road (Loop 1604 to IH 10) Project. Furthermore, re-advertising the project would not guarantee an experienced or as qualified consultant as Sundt Construction, Inc. who has worked on all prior project design phases and is working on the construction.
FISCAL IMPACT:
This ordinance recommends a one-time capital improvement expenditure in the total amount not to exceed $9,568,000.00 payable to Sundt Construction, Inc. to provide construction services related to the Hausman Road (Loop 1604 to IH 10) Project.
