Sports License Agreement with Southeast Apaches Football and Cheerleading Organization
 
 
SUMMARY:
 
This ordinance authorizes the continuation of a sports license agreement with Southeast Apaches Football and Cheerleading Organization at Copernicus Park located in Council District 2 for a term of five (5) years commencing on October 1, 2014, and ending on September 30, 2019.
 
BACKGROUND INFORMATION:
 
Southeast Apaches Football and Cheerleading Organization (League) has had a license agreement for this property for the past fourteen years.  As a result, League has been able to provide organized sports activity to area youth each summer and fall during this time with nearly 100 youth participants served last year.
 
Under the terms of the proposed license, in lieu of rent, League is responsible for maintenance of the licensed premises and will have priority use of the area.  Additionally, to offset operating costs, League may operate concessions and establish fees which are reasonable and customary for use of the premises by other sports groups.  This is consistent with other sports license agreements in effect for use and maintenance operations of City parks.  The fields are also open to the public when they are not in use by the League or other sports groups resulting in increased opportunities for youth recreation at Copernicus Park.  The League will have a term of five (5) years beginning on October 1, 2014, and ending on September 30, 2019.
 
 
ISSUE:
 
This ordinance authorizes a license agreement with Southeast Apaches Football and Cheerleading Organization for a term of five (5) years commencing on October 1, 2014, and ending on September 30, 2019.  This agreement is consistent with other sports license agreements in effect for use and maintenance of City parks.  This policy allows use of public parks by athletic organizations and provides organized youth recreational opportunities to the public.
 
 
ALTERNATIVES:
 
This sports license agreement will allow priority use of the premises in return for maintenance of the area, thus continuing the existing care arrangement for the fields and amenities. An alternative would be to require the organization to reserve the fields through the reservation system; however, the City would be responsible for the maintenance of the fields which would have a corresponding budgetary impact and the organization would be subject to available scheduling dates.
 
 
FISCAL IMPACT:
 
There is no fiscal impact to the General Fund.  Under the terms of the license agreement, the League will continue use of the fields at no charge and will continue to be responsible for providing all associated maintenance which will result in cost avoidance to the City.
 
 
RECOMMENDATION:
 
Staff recommends approval of this license agreement with Southeast Apaches Football and Cheerleading Organization at Copernicus Park for a term of five (5) years beginning on October 1, 2014, and ending on September 30, 2019.
