SUBJECT:
 
An Ordinance Appointing a Replacement City Councilmember for District 2.
 
 
SUMMARY:
 
On Tuesday, July 22, 2014 the Mayor and Council approved Resolution 2014-07-22-0027R acknowledging the Vacancy in the Office of City Council District 2.  Said action was necessary due to Councilmember Taylor being Elected as Mayor.    
 
The Office of the City Clerk accepted Applications for the City Vacancy from Monday, July 28, 2014 until 5:00 pm on Friday, August 8, 2014.  
 
At the Wednesday, August 13, 2014 "B" Session, Finalists were selected.  On Thursday, August 14, 2014 at the Regular City Council Meeting, each Finalist will be provided time to make a statement to the Mayor and Council.  Citizens signed up to speak on the Appointment will be heard.  The City Council will take an individual Roll Call Vote to fill the Vacancy.  In the event no one Finalist receives a Majority Vote, a second Vote will be conducted.  With at least 8 affirmative votes, the Appointment will take effect immediately.  After being Sworn-In by the City Clerk, the new Councilmember may take a seat on the Dais.
 
The City Council may recess into Executive Session on this matter at any time.
 
The Appointee will hold office until November 18, 2014; the date the City Council will be Canvassing the Election Results from the November 4, 2014 Special Election.    
 
 
BACKGROUND INFORMATION:
 
The Election of Ivy R. Taylor as Mayor on July 22, 2014 resulted in the City Council District 2 Vacancy.    
 
 
 
 
ISSUE:
 
The District 2 Vacancy is being filled in accordance with the provisions outlined in Section 8 of the City Charter which states that the City Council may appoint a person to serve as a Councilmember on a temporary basis.  City Ordinance 2010-05-06-0375 outlines the procedures for Appointment in the event of a Vacancy.  
 
Since more than 270 days remain on the unexpired term of office, the City shall also conduct a Special Election on Tuesday, November 4, 2014 to fill the balance of the Term of Office which is November 18, 2014 to May 31, 2015.  Said Special Election was called on July 22, 2014 via Ordinance 2014-07-22-0518.

FISCAL IMPACT:
 
There is no fiscal impact associated with the passage of this ordinance.  
 
 
RECOMMENDATION:
 
The City Council will follow the procedures established for the Vacancy and make an appointment.
