SUBJECT:
SAFD Personal Protective Clothing and Equipment
 
 
SUMMARY:
An Ordinance authorizing the execution of a contract with Morning Pride Manufacturing, LLC, d/b/a Honeywell First Responder Products, for the purchase, cleaning, and repair of firefighting bunker gear for the San Antonio Fire Department in an estimated annual amount of $500,000.00.  The initial term is February 1, 2014 through September 30, 2018 with 2, 1 year renewal options.  Funding is available from the Fire Department's FY2014 Adopted General Fund Operating Budget.
 
 
 
BACKGROUND INFORMATION:
Submitted for City Council consideration and action is the contract with Morning Pride Manufacturing, LLC, d/b/a Honeywell First Responder Products.  This contract will establish a reliable source for the supply of Personal Protective Clothing consisting of a bunker coat, bunker pants, bunker boots, suspenders and a hood.  Bunker gear is worn by firefighting personnel to provide protection during structural firefighting operations or other situations where there is a threat of fire.  Bunker gear is essential to protect firefighters when physical hazards are likely to be encountered.
 
This contract also provides for maintenance, repair and cleaning of Personal Protective Clothing in accordance with manufacturer's recommendations through a centrally located service facility.  Additionally, this contract requires that vendor maintain a computerized inventory system to track and maintain accurate records of maintenance, repairs, cleaning and placements of Personal Protective Clothing into the general, loaner or re-issuance pool.
 
The current Fire Collective Bargaining Agreement approved by City Council on October 1, 2009 states that each firefighter shall receive personal protective equipment provided by the City.  The State Commission on Fire Protection also requires that the City provide personal protective clothing to all individuals assigned to the firefighting division.  
 
A complete set of bunker gear is provided to each fire cadet upon graduation.  New bunker gear is also provided to incumbent firefighters as their gear becomes too old or is damaged beyond repair.  Standards established by the NFPA (National Fire Protection Association) require that all bunker gear be replaced after 10 years following the date of manufacture.  The Fire Department anticipates issuing new bunker gear to graduating cadets and replacement bunker gear to incumbents whose bunker gear is beyond repairs through the issuance of SAFD approved vouchers.
 
The original contract term will be for a base period of five years with two, one year renewal options under the same terms and conditions except for pricing, which is allowed to be revised based on the Producers Price Index (PPI).  After September 30, 2015, prices may be revised annually.
 
 
 
ISSUE:
This ordinance will provide the Fire Department with a contract for the purchase, cleaning and repair of Personal Protective Clothing for uniformed personnel.  The procurement was made through the use of a Public Health and Safety Exemption due to the sensitive and protective nature of the garments and fire-fighting gloves.  The SAFD Tool and Equipment committee has created this standard with zero deviation allowed for safety and collective bargaining reasons. Future purchases of bunker gear must be compatible with the existing inventory of bunker gear in order to maintain brand/product specificity.  The current bunker gear is under warranty with Morning Pride Manufacturing, dba Honeywell First Responder Products and meets the requirements of the State Fire Protections Commission (SFPC).
 
The Small Business Economic Development Advocacy Ordinance requirements were waived due to the lack of qualified SMWBE's available to provide the goods and services.
 
This is an exception to the Local Preference Program.
 
 
ALTERNATIVES:
Should this contract not be approved, the City of San Antonio would be in violation of the National Fire Protection Association Standards and the Collective Bargaining Agreement that went into effect October 1, 2009.
 
 
 
FISCAL IMPACT:
All expenditures will be in accordance with the Fire Department's FY2014 adopted budget approved by City Council.  Purchases made by the Fire Department are as needed and dependent upon available funds within their adopted budget.   
 
 
 
RECOMMENDATION:
Staff recommends approval of this ordinance to award an annual contract with Morning Pride Manufacturing, LLC, d/b/a Honeywell First Responder Products for supplying, cleaning, and repairing bunker gear in the estimated amount of $500,000.00 annually.
 
This contract is procured on the basis of a Public Health or Safety Exemption from the competitive bid process and therefore a Contracts Disclosure Form is not required.
