Amendment to an Interlocal Agreement with the San Antonio River Authority for the Mission Drive-In Redevelopment Project
 
 
SUMMARY:
 
An Ordinance for the Mission Drive-In Redevelopment Project, authorizing an amendment to an Interlocal Agreement (ILA) between the City of San Antonio and the San Antonio River Authority (SARA) for additional Low Impact Development (LID) Analysis Services in support of the City's Mission Area - Environmental Protection Agency (EPA) 319 Grant, and authorizing an amount not-to-exceed $17,000.00 to SARA.
 
BACKGROUND INFORMATION:
 
In 2010, the Transportation & Capital Improvements Department (TCI) sought an Environmental Protection Agency (EPA) 319 Grant through the Texas Commission on Environmental Quality (TCEQ) to fund the installation of on-site Low Impact Development (LID) storm water pollution reduction measures related to the Mission Drive-In Redevelopment project.  As part of the terms of the EPA 319 Grant, this project received 60% Federal Funding ($520,439.00) and a 40% Local Match ($346,959.00). The Mission Drive-In Redevelopment project is located on the 26-acre former Mission Drive-In, and has already completed the redevelopment of the Old Mission Drive-In Theater into the District 3 Mission Branch Library and the Mission Marquee Plaza. The Mission Drive-In Redevelopment site is a premier location which demonstrates and showcases the application of Low Impact Development (LID) Best Management Practices (BMPs) and features on-site storm water pollution reduction measures. This project will serve as testing model for LID technology uses in other locations throughout the San Antonio River Watershed. The grant funds also provide for Public Education, Unified Development Code (UDC) Review and Benefit-Cost analysis for LID technology.
 
The ultimate objective with the implementation of LID technology at this site is to evaluate the LID technology performance in the reduction of pollutant loads including total suspended solids, bacteria, and heavy metals contributed to the San Antonio River, and to determine if widespread use of LID technology would help improve the water quality in the San Antonio River. The selected LID measures include rainwater harvesting, bio-swales, rain gardens, surface detention/infiltration basins, a pervious plaza area and permeable parking surfaces.  The services included in the original ILA with SARA are associated with: Quality Assurance, BMP Monitoring, UDC Review, and Public Education as listed in the EPA 319 Grant.  Execution of the grant commenced shortly after Council approval in August 2011 and all components are scheduled to be completed in June 2015.
Previous Council Action
The EPA 319 Grant was previously approved by Council with City Ordinance 2011-08-04-0610, August 4, 2011, which accepted $520,439.00 from the EPA and provided $346,959.00 as a Local Match to fund the installation of on-site LID storm water pollution reduction measures in conjunction with the Mission Drive-in Redevelopment project.  
 
The ILA with the SARA was previously approved by Council with City Ordinance 2013-08-15-0546, on August 15, 2013, to provide environmental and administrative services in an amount not-to-exceed $52,843.00 in support of the EPA 319 Grant.
 
ISSUE:
 
This ordinance for the Mission Drive-In Redevelopment Project authorizes an amendment to an Interlocal Agreement (ILA) between the City of San Antonio and the San Antonio River Authority (SARA) for additional Low Impact Development (LID) Analysis Services in support of the City's Mission Area - Environmental Protection Agency (EPA) 319 Grant, and authorizing an amount not-to-exceed $17,000.00 payable to SARA.
 
The services included in this amendment are for completing the EPA 319 Cost-Benefit Analysis and the Final Project Report, respectfully, which were not included in the original ILA.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to approve this amendment which would require TCI to acquire these services from another consultant as in-house resources do not have adequate expertise.  The time duration required to enter into an agreement with a new consultant would delay submitting the final deliverables to TCEQ which are required to be completed by June 2015 and would cause the City to become non-compliant with the 319 Grant.  In addition SARA possesses the familiarity with the project as well as the knowledge of LID technology required to complete the contract deliverables on time and in an expedited manner.
 
 
FISCAL IMPACT:
 
This ordinance amending the ILA with SARA for additional Low Impact Development (LID) Analysis Services in support of the City's Mission Area- EPA 319 Grant: authorizes payment to SARA in an amount not-to-exceed $17,000.00. Funds are available from the EPA 319 Grant previously approved by City Council on August 4, 2011.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance authorizing an amendment to an Interlocal Agreement (ILA) between the City and the SARA to provide additional services in support of the City's Mission Area - EPA 319 Grant with an amount not to exceed $17,000.00 to SARA.
