SUMMARY:
This Ordinance designates the Heritage South Sector Plan and the United Southwest Community Plan as the land use and intensity plans for the South San Antonio Limited Purpose Annexation that was approved by City Council on January 9, 2014, in accordance with Texas Local Government Code Chapter 43.127.
The Department recommends approval. The Planning Commission recommendation pending the December 3, 2014 public hearing.
BACKGROUND INFORMATION:
On January 9, 2014, the City Council approved Limited Purpose Annexation of South San Antonio Areas 1 - 4, consisting of 36 square miles generally located south of Loop 410, between Old Pearsall Road and US Highway 181. Texas Local Government Code Chapter 43.127 requires municipalities to develop a land use and intensity plan for areas subject to Limited Purpose Annexation within one year of the date of annexation. The majority of the annexed area is located within the boundaries of the Heritage South Sector Plan, with the remaining portions being located within the United Southwest Community Plan boundaries. The Department of Planning & Community Development requests that the United Southwest Community Plan and the Heritage South Sector Plan officially be designated as the land use and intensity plans for the South San Antonio Limited Purpose Annexation.
ISSUE:
The South San Antonio Limited Purpose Annexation triggers the Texas Local Government Code Chapter 43.127 requirements: "By the end of the first year after the date an area is annexed for limited purposes, the municipality must develop a land use and intensity plan as a basis for services and capital improvements projects planning."
ALTERNATIVES:
No action will result in the United Southwest Community Plan and the Heritage South Sector Plan not being designated as the land use and intensity plan for the South San Antonio Limited Purpose Annexation.
FISCAL IMPACT:
There is no direct financial impact associated with the passage of this Ordinance.
RECOMMENDATION:
Staff recommends approval. Planning Commission recommendation pending the December 3, 2014 public hearing.
