Amendment to an Advanced Funding Agreement on the Callaghan Road Project
 
SUMMARY:
An ordinance authorizing an amendment accepting an additional amount from TxDOT up to $1,652,788.00 to extend the Callaghan Road Project limits from IH410 to Spur 421 (Bandera Road) and authorize payment in the amount of $11,570.00 to the TxDOT for state oversight costs for the Callaghan Road Project, a 2012 - 2017 General Obligation Bond funded project, located in Council District 7.
 
BACKGROUND INFORMATION:
Project Background
The City's Callaghan Road Project is an authorized 2012 - 2017 General Obligation Bond Project which has $6,630,000.00 in City funding and $8,708,128.00 in federal funding and provides for turn lanes, sidewalks and drainage improvements from Centerview Drive to Evers Road.   Per the Federal Highway Administration direction to adjust the termination points of the Callaghan Project, extended Project limits were requested and approved by the Metropolitan Planning Organization (MPO), adjusting the limits from IH410 to Spur 421 (Bandera), adding around a quarter of a mile to the Project.  Due to that extension, an additional $1,652,788.00 in federal funds was made available to the Project.  The City will design and construct the roadway improvements, leveraging funding and state oversight from TxDOT. Design currently is at 70% completion and the Project construction is anticipated to begin in October 2015, completing in July 2017.
 
Previous Council Action
A previously executed Advanced Funding Agreement with the TxDOT, in the reimbursable amount of $8,708,128.00 for the Callaghan Road Project, was approved by City Council on June 6, 2013 through Ordinance 2013-06-13-0416.  This amendment will increase that agreement by $1,652,788.00.  This is the first amendment to this Agreement.

This Advanced Funding Agreement with the TxDOT allows for the construction costs to qualify for federal cost sharing for construction and construction-related costs up to a new federally approved limit of $10,360,916.00.
 
 
ISSUE:
This ordinance authorizes an amendment, in the increased reimbursable amount of $1,652,788.00, to the Advanced Funding Agreement with the Texas Department of Transportation (TxDOT) to extend the Callaghan Road Project limits from IH410 to Spur 421 (Bandera Road) and authorizes payment, in the amount of $11,570.00 to the TxDOT for state oversight costs for the Callaghan Road Project, a 2012 - 2017 General Obligation Bond funded project, located in Council District 7.
 
The Callaghan Road Project, a 2012-2017 Bond Project, called for the design and reconstruction of Callaghan Road from Centerview to Evers Road, providing turn lanes at several intersections and improving drainage and utilities.
 
Per the Federal Highway Administration direction to adjust the termination points of the Callaghan Project, extended Project limits were requested and approved by the Metropolitan Planning Organization (MPO), adjusting the limits from IH410 to Spur 421 (Bandera).  Due to that extension, an additional $1,652,788.00 in federal funds was made available to the Project.
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2012-2017 General Obligation Bond funded projects.
 
ALTERNATIVES:
City Council could choose not to approve this item and miss the opportunity to expand Project limits with no increase to the City's portion of the budget.  
 
FISCAL IMPACT:
This ordinance amends the Advanced Funding Agreement with the TxDOT to provide for reimbursement of construction costs associated with the construction of Callaghan Road from IH410 to Spur 421 (Bandera Road).
 
A share of the construction costs, in the additional amount not to exceed $1,652,788.00, shall be reimbursed to the City of San Antonio by the TxDOT as part of the Local Agency Management Program (LAM). Actual costs to be reimbursed by the TxDOT will be finalized with the awarding of a construction contract. LAM projects are managed by the City but receive federal funds administered through the TxDOT. The funds paid to the TxDOT by the City are for costs associated with oversight for administration of the federal funds.  The City agrees to pay the TxDOT an additional not-to-exceed amount of $11,570.00 for state oversight cost. This street project is included in the FY 2014 through FY 2019 Capital Improvement Program. Funds are available from the 2012-2017 General Obligation Bond funds and are included in the project's contingency fund.  No additional City funds are expected to be required for the Project.
 
RECOMMENDATION:
Staff recommends approval of this ordinance amending the Advanced Funding Agreement with the Texas Department of Transportation (TxDOT), increasing the federal reimbursement estimate by $1,652,788.00 and authorizing a payment of $11,570.00 to the TxDOT for state oversight costs.
