36th Street Phase IIIB - Billy Mitchell to General Hudnell, ILA Amendment
 
 
SUMMARY:
An ordinance authorizing an amendment of $267,364.00 to the $150,000.00 Interlocal Agreement with the Port Authority of San Antonio related to the $6 million, 36th Street Phase IIIB (Billy Mitchell to General Hudnell) Project, to increase the construction scope of work managed by the Port Authority located in Council District 4, funded by the Federal Highway Administration and 2012-2017 General Obligation Bonds.
 
BACKGROUND INFORMATION:
 
Project Background
36th Street Phase IIIB (Billy Mitchell to General Hudnell) will extend 36th street through the Port of San Antonio from Billy Mitchell to General Hudnell and will include street, drainage, sidewalk, bike lane, traffic signalization, landscaping and utility improvements. This project is a continuation of a three-phase 36th Street Corridor project which intends to create a major thoroughfare extension into the Port of San Antonio to connect US Highway 90 to IH 35.  The previous two City projects that have been completed include: 36th Street Phase II (US 90 to Growdon) completed in 2013 and 36th Street Phase IIIA (Growden to Billy Mitchell) completed in 2012.  
 
The Port Authority hired the design consultant and paid for the design of Phase IIIB using its own funds. The design consultant's tasks include bid reviews and recommendations, quality assurance that the project is being constructed accurately, according to the design specifications, and review of pay estimates. Additionally, the Port Authority's consultant will provide design modifications should unforeseen site conditions come about. Such services are usually included as part of the City's design consultant contract for construction projects; however, the City did not manage the design of this project.
 
Project construction of Phase IIIB is anticipated to begin in Spring 2015 and be completed in Fall 2016.    
 
 
Previous Council Action
A previously executed Interlocal Agreement (ILA) with the Port Authority was approved by City Council on March 13, 2014 through Ordinance 2014-03-13-0159 in an amount not to exceed $150,000.00 in order for the City to reimburse the Port Authority for their design consultant's expenses related to construction administration associated with the 36th Street Phase IIIB (Billy Mitchell to General Hudnell) Project.
 
 
ISSUE:
 
This ordinance provides for communication line adjustments and authorizes an amendment to an Interlocal Agreement with the Port Authority of San Antonio related to the $6 million 36th Street Phase IIIB (Billy Mitchell to General Hudnell) 2012-2017 Bond Program Project, an authorized Local Agency Management (LAM) Project located in Council District 4, funded by the Federal Highway Administration and 2012-2017 General Obligation Bonds, in the increased amount of $267,356.00
 
As requested by the City, this amendment authorizes an amount not to exceed $267,364.00 payable to the Port Authority of San Antonio for costs associated with the movement, adjustment, replacement and installation of telecommunication cables to support the Port and Air Force infrastructure, which is impacted by the construction of the 36th Street Phase IIIB Project.  Due to the sensitivity and security required to make these communication line adjustments, the Port Authority will utilize an existing contract for the completion of the work and such contract has already been approved by the Air Force. Because of procurement regulations, the City could not guarantee it would be able to select the Air Force's approved vendor.   This amendment authorizes the City to reimburse the Port Authority for communication line adjustments when invoices are provided.
 
This is the first amendment to the ILA and this amendment will increase the agreement by $267,364.00 to an amount not to exceed $417,364.00.

Approval of this ordinance will be a continuation of City Council policy to collaborate with other agencies in supporting the City's commitment to maintaining and improving existing infrastructure.
 
ALTERNATIVES:
 
City Council could choose not to approve this amendment and require staff to solicit for the communication line work to be performed.  Considering the additional time required for solicitation process and acquiring approval from the Air Force due to the sensitivity of the infrastructure, this would adversely affect the timely completion of the project.
 
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in an amount not to exceed $267,364.00 authorized payable to the Port Authority of San Antonio upon receipt of invoices.  Funds are available from previously authorized 2012-2017 General Obligation Bonds and included within the FY 2015 - 2020 Capital Improvement Program Budget.  
 
The City's 2012-2017 General Obligation Bond contribution is $6,000,000 for the project for a total budget of $7,742,609.00.  The Federal Highway Administration funding contribution to the 36th Street Phase IIIB (Billy Mitchell to General Hudnell) project is $1,742,609.00.  
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance authorizing the first Amendment to the Interlocal Agreement with the Port Authority of San Antonio for the 36th Street Phase IIIB - Billy Mitchell to General Hudnell Project.
