Contract Award: Storm Drain System from E. Sunshine Drive to Rosemont Drive
 
SUMMARY:
 
An ordinance related to the construction of the Storm Drain System from E. Sunshine Drive to Rosemont Drive, an Upper Woodlawn Drainage project, accepting the lowest responsive bid and awarding a construction contract in the amount of $2,590,220.54, authorized payable to San Antonio Constructors, Ltd.,  a 2012-2017 Bond funded Project, located in Council District 7.  San Antonio Water Systems (SAWS) will reimburse $119,482.15 for its work and $2,470,738.39 will be used for construction with City funds.  The total budget amount in the 2012-2017 General Obligation Bond Program was $3,000,000 and an additional $550,000.00 in Storm Water Regional Facility funds will be available upon the adoption of the FY 2015-2020 Capital Improvement Program Budget.   The balance of the remaining project funds will be used for design, design services, environmental services, advertising, and project management.  
 
 
BACKGROUND INFORMATION:
 
Project Background
In May 2011, City Council approved the reallocation of approximately $47 million in Bond Program savings.  As part of this reallocation, $400,000.00 was provided for completion of a drainage study of the Upper Woodlawn Lake area watershed.  The area is bounded by Interstate Highway 10 to the north and east, Hillcrest and Bandera Road to the west and Woodlawn Lake to the south.  This area has experienced flooding over the years and several separate studies and projects have been developed to help alleviate the problem.  The study compiled all of the available studies and project information (from both Bexar County and City) to provide analysis on potential projects within the Upper Woodlawn Lake area to address flood control issues.  
 
The two most cost effective projects based on the number of "at-risk properties" to be removed from the floodplain versus cost per property were selected: A Storm Drain System from E. Sunshine Drive to Rosemont Drive and the San Antonio Independent School District (SAISD) Storm Water Detention Project.  
 
On September 4, 2014 City Council approved a funding agreement in the amount of $750,000 with SAISD for the construction of the SAISD Storm Water Detention Project, one of two identified projects in the watershed.  The SAISD Storm Water Detention Project will be funded using Storm Water Regional Facility funds.
 
The E. Sunshine Dr. to Rosemont Drive Project provides for the construction of culvert improvements at E. Sunshine Dr. and Rosemont, channel improvements downstream to Rosemont, and underground storm drain improvement, approximately 100-linear feet downstream of Rosemont, with approximately 235-linear feet of water improvements and 100-linear feet of sewer improvements.   Project construction is anticipated to begin October 2014 and estimated to be completed by May 2015.
 
Procurement of Services.
This Project was advertised for construction bids in July 2014 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA, and through the TCI Small Business Office.  Plans also were available for review by potential bidders at the office of San Antonio Design Group, 12719 Spectrum Drive, Suite 100, San Antonio, Texas, 78249.  Bids for this Project were opened on July 29, 2014 and four (4) bidders responded.  Of these, San Antonio Constructors, Ltd. submitted the lowest responsive bid.  A matrix of the bid outcome is included herein as Attachment 2.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 15% Small Business Enterprise (SBE) subcontracting goal and a 7% Minority/Women Business Enterprise (M/WBE) subcontracting goal. San Antonio Constructors, Ltd. has committed to 15.6% SBE subcontractor participation and 15.6% M/WBE subcontractor participation.  San Antonio Constructors, Ltd. is also a certified small business, bringing total SBE participation to 100%.
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
ISSUE:
 
An ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $2,590,220.54, to San Antonio Constructors, Ltd., for construction of the Storm Drain System from E. Sunshine Drive to Rosemont Drive, a 2012-2017 Bond funded Project, located in Council District 7.  Of this amount, $119,482.15 will be reimbursed by SAWS for its work.
 
This project, Storm Drain System from E. Sunshine Drive to Rosemont Drive, is one of two most cost effective projects based on studies in the Upper Woodlawn drainage watershed.  The number of "at-risk properties" to be removed from the floodplain versus cost per property was the driving factor in the selection of the projects.
 
The Storm Drain System from E. Sunshine Drive to Rosemont Drive Project will increase the capacity of the existing culvert crossing (a bridge like structure that allows water to flow below and vehicular traffic on top) at E. Sunshine Drive, will deepen the existing concrete channel to increase capacity downstream to Rosemont, and will increase the capacity of the existing underground storm drain system approximately 100-linear feet downstream of Rosemont, with approximately 235-linear feet of water improvements and 100-linear feet of sewer improvements.  The culvert improvements will impact the traffic on E. Sunshine and Rosemont, but construction will be phased to where only one crossing will be closed at a time.  Traffic detour plans are in place and staff will ensure contractor implements then during construction.  Project construction is anticipated to begin October 2014 and estimated to be completed by May 2015.
 
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2012-2017 Bond funded Projects.
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.  
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the amount of $2,590,220.54, authorized payable to San Antonio Constructors, Ltd.  Of this amount, $119,482.15 will be reimbursed by SAWS, $1,920,738.39 will be funded by 2012-2017 General Obligation Bonds and $550,000.00 in Storm Water Regional Facility funds will be contingent upon the adoption of the FY 2015-2020 Capital Improvement Program Budget.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $2,590,220.54, authorized payable to San Antonio Constructors, for construction of Upper Woodlawn Drainage, from E. Sunshine Drive to Rosemont Drive.
