Contract Award: Indian Creek Channel Phase II
SUMMARY:
An Ordinance for Indian Creek Channel Phase II from Five Palms to Medina Base Road, awarding a construction contract in the amount of $2,745,921.49 to Construction Resolution Group, of this amount, $575,215.58 will be reimbursed by San Antonio Water Systems and $50,600.00 will be reimbursed by CPS Energy, a 2012-2017 Bond-funded Project located in Council District 4.
BACKGROUND INFORMATION:
Project Background
The 2012-2017 General Obligation Bond Program authorized $6,499,000 for Indian Creek Channel Phase II and, of that, $2,120,105.91 will be used for construction. The balance of the Project funds will be used for property acquisition, design services, environmental services, advertising and project management, with any remaining funds to be realized as bond savings.
This Project provides for improvements to portions of the Indian Creek Channel, from Five Palms Drive to Medina Base Road. Improvements include the reconstruction of the Elm Valley Drive culvert crossing, drainage improvements south of Medina Base Road and channel improvements which will require an average of four feet of excavation along the earthen channel between Medina Base Road and Lackland Spur. The project also includes widening and concrete erosion protection, in various locations throughout the Project area. These improvements will improve the 100 year floodplain conditions for this area and will result in an estimated 12 homes being removed from the floodplain. Additionally, 27 lots that were partially within the floodplain will be 100% removed upon completion of the project.
Procurement of Services
This Project was advertised for construction bids in the San Antonio Hart Beat, on the City’s website and the Texas Electronic State Business Daily in August 2015. In addition, the bid announcement was made on TVSA and through TCI. Bids for this Project were opened on September 1, 2015 and nine bidders responded. Of these, Construction Resolution Group submitted the lowest responsive bid. A matrix of the bid outcome is included herein as Attachment 2.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 2% African American Business Enterprise (AABE) subcontracting goal. Construction Resolution Group has committed to 24.05% M/WBE and 2.19% AABE subcontractor participation.
ISSUE:

Construction is anticipated to begin in November 2015 and estimated to be completed in October 2016. Construction activities will take place six days a week from sunrise to sunset.
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the total amount of $2,745,921.49, payable to Construction Resolution Group. Of this amount, $575,215.58 will be reimbursed by SAWS and $50,600.00 will be reimbursed by CPS Energy. Funds are available from the 2012-2017 General Obligations Bonds and are included in the FY 2016 - 2021 Capital Improvements Program Budget.
RECOMMENDATION:
Staff recommends approval of this ordinance awarding a construction contract in the amount of $2,745,921.49 to Construction Resolution Group, for construction of the Indian Creek Channel Phase II Project.
