Change Order: Menger Creek Drainage-Trail Lighting

 

 

SUMMARY:

 

An ordinance for Menger Creek Drainage Project authorizing a change order in the amount not to exceed $143,220.00 to the existing $7,407,861.70 construction contract with EZ-Bel Construction, LLC for electrical service and the construction of trail lighting, a Certificates of Obligation funded project, located in District 2.

 

 

BACKGROUND INFORMATION:

 

On May 12, 2012, voters approved the 2012-2017 Bond Program which authorized $6,526,000.00 for Menger Creek Drainage project.  On December 4, 2014, City Council authorized an Interlocal Agreement between the City of San Antonio and Bexar County accepting funds in the amount of $2,800,000.00 from the Bexar County Flood Control Program and increasing the project budget to a total of $9,056,000.00. 

 

The Menger Creek Drainage project provides for the construction of channel improvements, a span bridge at Rio Grande Street, culvert improvements at the Union Pacific Railroad Bridge, a pedestrian bridge at Grimes Street and a Linear Park trailway along the Menger Creek channel. The culvert improvements and the Rio Grande Bridge will significantly reduce water surface elevation along the channel.

 

Although initially solicited within the project, electrical improvements including trail lighting and were excluded from the project.  After careful consideration and discussion with the contractor, this change order will fund the electrical and trail lighting as requested by the community and will enhance the safety of pedestrians using the Menger Creek Park.

 

Previous Council Action

A previously executed contract with EZ-Bel Construction, LLC in the amount of $7,407,861.70 was approved by City Council on October 15, 2015, through Ordinance 2015-10-15-0869. Previous change orders including: aqua dams, the replacement of the 6-inch polyvinyl chloride (PVC) pipe underdrain with a 10-inch high-density polyethylene (HDPE) pipe for constant water flow, water diversion for fiber optic line adjustment and insurance coverage required by UPRR to commence work within the UPRR Right-Of-Way (ROW) have increased this contract amount by $64,910.59 to a total contract amount of $7,472,772.29. This change order will increase the contract by $143,220.00 to a total contract amount of $7,615,992.29. The following table illustrates the change orders that have occurred since construction of this project began:

ISSUE:

 

This ordinance for Menger Creek Drainage authorizing a change order in the amount not to exceed $143,220.00 to the existing $7,407,861.70 construction contract with EZ-Bel Construction, LLC for the construction of electrical service and the construction of trail lighting, a Certificates of Obligation funded project, located in District 2.

 

The scope of work includes installation of trail lighting over the entire trial from the main service panel at Walters to the trail end near Onslow Street. Additionally, security lighting will be placed at two exercise nodes and two picnic pavilions located along the trail route. To provide the trail lighting, electrical wires will be placed inside plastic piping and located underground, near the trail. Electrical service panels will be placed at three locations on the trail. The service panels are to be utilized by the Parks Department for service and maintenance.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to approve this change order; however, not approving the change order would mean Menger Creek Drainage project will be unable to provide trail lighting for the Menger Creek Linear Park.

 

 

FISCAL IMPACT:

 

This is a one-time capital improvement expenditure in the amount of $143,220.00 payable to EZ-Bel Construction, LLC related to the installation of electrical service and trail lighting along the Menger Creek Linear Park. Linear Park amenities and trailway improvements along Menger Creek are being funded from 2016 Certificates of Obligation previously reallocated to this project per Ordinance 2015-10-15-0869.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance and authorizing payment to EZBel Construction, LLC in the amount of $143,220.00 for electrical trail lighting for Menger Creek Linear Park located in Council District 2.
