SUMMARY:
 
Consideration of an ordinance authorizing the closure, vacation and abandonment of a 0.218 acre, 22-foot wide alley Public Right of Way, located between North Brazos Street and Fredericksburg Road (NCB 2022), in Council District 1, as requested by Higgs Carter King GT Charter Academy, for a fee of $25,100.00.
 
BACKGROUND INFORMATION:
 
Higgs Carter King GT Charter Academy (petitioner) is requesting the closure, vacation and abandonment of a 22 foot-wide alley Public Right of Way located between North Brazos Street and Fredericksburg Road as shown on attached Exhibit A.  The requested closure is 0.218 of an acre (9,499 square feet) and is an undeveloped alley that is not open to public travel.  The petitioner owns most of the surrounding properties, which is shown within the blue border on the Exhibit.  The one other abutting property owner is in agreement to the proposed closure.  If approved, the closure will allow the petitioner to provide a safe environment for the students and staff by controlling on site traffic circulation and parking.
 
 
ISSUE:
 
This ordinance will authorize the closure, vacation and abandonment of a 0.218 acre, 22-foot wide alley Public Right of Way, located between North Brazos Street and Fredericksburg Road (NCB 2022), in Council District 1, as requested by Higgs Carter King GT Charter Academy, for a fee of $25,100.00.
 
The proposed closure is an undeveloped alley that is not open to public travel.  If approved, the closure will allow the petitioner to provide a safe environment for the students and staff by controlling on site traffic circulation and parking.
 
This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property.
 
 
ALTERNATIVES:
 
City Council could choose not to approve this request; however, that would disallow the petitioner from providing a safe environment for the students and staff by controlling on site traffic circulation and parking. Also, the City's liability would continue along with the obligation for maintenance.
 
 
FISCAL IMPACT:
 
The fair market value of the Right of Way is $31,000.00, which was established by an appraisal performed by Debra S. Runyan, MAI on November 14, 2013.  The value was reduced by 25% in accordance with the reduction provided by the Inner City Reinvestment/Infill Policy (ICRIP); therefore, the City will collect a fee of $25,100.00 for the closure, vacation and abandonment of this Public Right of Way.  The fee includes administrative fees for the appraisal and recordation.  This fund will be deposited into the General Fund in accordance with FY 2014 Adopted Budget.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance to authorize the closure, vacation and abandonment of a 22-foot wide alley Public Right of Way in Council District 1.
 
The City of San Antonio's Planning Commission reviewed and approved this request at its regular meeting of May 14, 2014.
