Contract Award: Fay Avenue Drainage (New Laredo Hwy. to Somerset Rd.)
SUMMARY:
An Ordinance for Fay Avenue Drainage Improvements (New Laredo Highway to Somerset Road) awarding a construction contract in an amount not to exceed $1,399,791.39, to D. Plata Construction Co., LLC, of which $265,015.49 will be reimbursed by San Antonio Water Systems and $548,350.00 will be reimbursed by CPS Energy, a Storm Water Revenue Bond and Community Development Block Grant funded project located in Council District 5.
BACKGROUND INFORMATION:
The total funding authorized for the Fay Avenue Drainage Improvements Project (New Laredo Highway to Somerset Road) is $1,070,000.00. The Storm Water Revenue Bond authorized $520,000.00, the FY 2014 CDBG Program authorized $350,000.00 and the FY 2015 CDBG Program authorized $200,000. The amount to be used for construction is $586,425.90 and the balance of the Project funds approved shall be used for design services, environmental services, advertising and project management.
This Project provides for the reconstruction of approximately 0.2 miles of Fay Avenue, from New Laredo Highway to Somerset Road, including two 11-foot travel lanes, a 4-foot wide sidewalk, curbs and driveway approaches. Additionally, a 30-inch underground storm drain system will be constructed within the project limits to eliminate flooding of the adjacent properties.
A Public meeting was held on October 23, 2014, at the Pan American Library to inform the community of the Project details and to coordinate with businesses and residents. Project construction is anticipated to begin in November 2015 and is estimated to be completed by September 2016. Construction activities will take place six days a week, sunrise to sunset.
Procurement of Services:
This Project was advertised for construction bids in August 2015 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, and on TVSA. Bids for this Project were opened on August 25, 2015 and six bidders responded. Of these, D. Plata Construction Co., LLC submitted the lowest responsive bid.
This contract will be awarded in compliance with the United States Department of Housing and Urban Development’s Section 3 Program, which requires economic opportunities be directed to low-income persons and businesses. The Office of Grants Monitoring and Administration will review and approve a Section 3 Utilization Plan submitted by the Respondent prior to the commencement of contract activity, as required by CDBG funding requirements. Reporting of actual activity will be required on a monthly basis until Project completion.
ISSUE:

Coordination with businesses and local residents will be made to ensure accommodations are in place to maintain accessibility during construction. Some of those accommodations include providing temporary driveway access to residential and commercial properties to minimize traffic inconveniences to the traveling public.
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of this Project.
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount $1,399,791.39, authorized payable to D. Plata Construction Co., LLC. Of this amount, $586,425.90 is the City’s portion, $265,015.49 will be reimbursed by SAWS and $548,350.00 will be reimbursed by CPS Energy. Funds are available from the Storm Water Revenue Bond and from the FY 2014 and FY 2015 CDBG Program Funds.
RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $1,399,791.39, payable to D. Plata Construction Co., LLC, for construction of the Fay Avenue Drainage Improvement Project.
