SUBJECT:
 
Extension of an existing lease for a period of five-years with Brooks Development Authority for a term ending January 31, 2019 for use of property for the San Antonio Police Department's K-9 and Bomb Detail Units.
 
SUMMARY:
 
This ordinance authorizes the five-year lease extension with Brooks Development Authority (BDA) to continue the use of the existing San Antonio Police Department's (SAPD) K-9 and Bomb Detail Units facilities located at 2614 Enos Street within the Brooks City-Base development in Council District 3 for a term ending January 31, 2019.
 
BACKGROUND INFORMATION:
 
Pursuant to a prior Council action in January 2009, the City entered into a five-year lease agreement with BDA to use the subject property for purposes of housing SAPD's K-9 and Bomb Detail Units.  Provisions of that lease provided the right to extend the occupancy for an additional five-year term and the action contemplated by this recommendation would exercise that option allowing the City to continue using the property through January 31, 2014.
 
 
ISSUE:
 
The existing lease will expire on January 31, 2014 and SAPD's K-9 and Bomb Detail Units has a continuing need to use these facilities.
This ordinance will authorize a five-year extension of the occupancy under the same rates and terms as presently provided.
 
 
ALTERNATIVES:
 
The proposed lease extension will allow the City to continue to use these facilities for police purposes.  Should the recommended actions not be implemented, SAPD will need to identify additional fiscal capacity within their present budget to construct or lease replacement kennel facilities to maintain the level of services presently provided by the K-9 and Bomb Detail Units. It is not likely that a more cost effective alternative can be identified.
 
 
FISCAL IMPACT:
 
The City will lease these facilities on a gratis basis.  Therefore, over the five-year term there will be no financial payments from the City to Brooks Development Authority.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance authorizing the execution of a lease extension agreement with Brooks Development Authority to allow the SAPD use to be extended an additional five-year term ending January 31, 2014.
