Amendment to the Personal Protective Clothing Contract
SUMMARY:
This ordinance authorizes an amendment to the Personal Protective Clothing contract with Morning Pride Manufacturing, LLC. to extend the contract for a period of four months in an amount not to exceed $110,000.00. The extension period of the contract will be from October 1, 2013 to January 31, 2014. Funding for this agreement is available within the FY2014 Fire Department General Fund budget. This ordinance will be effective immediately with the passage of eight (8) affirmative votes.
BACKGROUND INFORMATION:
The Personal Protective Clothing contract with Morning Pride Manufacturing, LLC was approved by City Council on December 11, 2008 (Ordinance# 2008-12-11-1139). Personal Protective Clothing consists of a bunker coat, bunker pants, bunker boots, suspenders and a hood. The current Fire Collective Bargaining Agreement approved by City Council on October 1, 2009 states that each firefighter shall receive personal protective equipment provided by the City. The State Commission on Fire Protection also requires that the City provide personal protective clothing to all individuals assigned to the firefighting division. The purpose of this contract is for purchasing, cleaning, and repairing of the personal protective clothing.
The original contract term was for two years with up to three one-year extension periods under the same terms and conditions except for pricing, which is allowed to be revised based on the Producers Price Index (PPI). Ordinance# 2010-09-30-0849 approved the first one-year extension from October 1, 2010 to September 30, 2011. Ordinance# 2011-09-29-0773 approved the second one-year extension from October 1, 2011 to September 30, 2012. Ordinance #2012-09-06-0667 approved the third and final extension from October 1, 2012 to September 30, 2013.
A new term contract for Personal Protective Clothing is currently being negotiated and is scheduled for Council consideration in January 2014. Continued use of the existing contract with Morning Pride Manufacturing LLC will require Council approval based upon existing change order authority.
ISSUE:
This ordinance will enable the Fire Department to extend the contract providing for the purchase, cleaning and repair of Personal Protective Clothing for uniformed personnel as required per the Collective Bargaining Agreement.
ALTERNATIVES:
If the City does not execute this contract for Personal Protective Clothing, the City of San Antonio would be in violation of the National Fire Protection Association Standards and the Collective Bargaining Agreement that went into effect October 1, 2009.
FISCAL IMPACT:
This ordinance provides for amendment and extension of the Fire Department Personal Protective Clothing contract with Morning Pride, LLC in an amount up to $110,000.00. This four (4) month extension is from October 1, 2013 to January 31, 2014. Funding for this agreement is available within the FY2014 Fire Department General Fund budget.
RECOMMENDATION:
Staff recommends approval of this ordinance to amend and extend the contract with Morning Pride Manufacturing, LLC, for Personal Protective Clothing.
