SUBJECT:
Contract Award: Frio City Rd Sidewalks (Brazos to W. Malone)
 
SUMMARY:
An ordinance related to the construction of Frio City Road Sidewalk, from Brazos to W. Malone, accepting the lowest responsive bid and awarding a construction contract in the amount of $2,617,258.34, authorized payable to EZ-Bel Construction, LLC, a 2012-2017 Bond-funded Project, located in Council District 5. Of this amount, $16,000.00 will be reimbursed by San Antonio Water Systems (SAWS) for its work and the remaining $2,601,258.34 will be funded by the 2012-2017 General Obligation Bond program.
 
BACKGROUND INFORMATION:
Project Background
This Project, approximately 3 miles in length, provides for the construction, on both sides of the road, of sidewalks, curbs and driveway approaches, as necessary, with pavement mill and overlay and striping along Frio City Road, from Brazos to W. Malone, as well as traffic signal improvements at the Zarzamora intersection and SAWS water adjustments. Frio City Road is a 3-lane roadway with bike lanes which transitioned to an offset 2-lane roadway with curbside parking on the northern limits of the Project.  Along the project limits, the existing sidewalks are in poor condition and there are gaps that do not provide connectivity to the existing bus stops.  The pavement markings are also in poor conditions and will be replaced.  There will be minimal impact to the traffic as most of the work will be done outside of the travel lanes.  
 
A Public Meeting was held on May 2014 at the Collins Garden Branch Library to inform the public of the project.  
 
Project construction is anticipated to begin September 2014 and estimated to be completed by March 2015.  The contractor will work six days a week, sunrise to sundown.  
 
Procurement of Services.
This Project was advertised for construction bids in the San Antonio Hart Beat, on the City's website and the Texas Electronic State Business Daily in June 2014. In addition, the bid announcement was made on TVSA and through the TCI Small Business Office. Plans also were available for review by potential bidders at the office of RJ Rivera & Associates, Inc. located at 601 NW Loop 410, Ste. 410, San Antonio, Texas 78216. Bids for this Project were opened on July 22, 2014 and four (4) bidders responded. Of these, EZ-Bel Construction, LLC submitted the lowest responsive bid. A matrix of the bid outcome is included herein as Attachment 2.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 17% Small Business Enterprise (SBE) subcontracting goal and 11% Minority/Women Business Enterprise (M/WBE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by EZ-Bel Construction, LLC F.A. because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.  EZ-Bel Construction, LLC is also a certified small business.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
ISSUE:
An ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $2,617,258.34, authorized payable to EZ-Bel Construction, LLC, for construction of the Frio City Road Sidewalks, from Brazos to W. Malone, a 2012-2017 Bond funded Project, located in Council District 5.
 
Of this amount, $16,000.00 will be reimbursed by SAWS for its work. The total budget amount in the 2012-2017 General Obligation Bond program was $5,000,000 and of that $2,601,258.34 will be used for construction. The balance of the Project funds approved by voters will be used for design services, environmental services, advertising and project management, with any remaining funds to be realized as bond savings that will be utilized for the design and construction of neighborhood sidewalks in the area.  
 
This contract provides for the construction of sidewalks, curbs and driveway approaches as necessary with pavement mill & overlay and striping along Frio City Road, from Brazos to W. Malone, with traffic signal improvement at the Zarzamora intersection and SAWS water adjustments. Project construction is anticipated to begin in September 2014 and is estimated to be completed by March 2015.
 
Approval of this ordinance will be a continuation of City Council policy to complete previously approved 2012-2017 Bond funded Projects.
 
ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $2,617,258.34, authorized payable to EZ-Bel Construction, LLC. Of this amount, $2,601,285.34 will be funded by 2012-2017 Street Bonds, $16,000.00 will be reimbursed by SAWS. Funds are available and are included in the FY 2014 - 2019 Capital Improvements Budget.
 
RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $2,617,258.34, authorized payable to EZ-Bel Construction, LLC. for construction of Frio City Rd Sidewalks from Brazos to W. Malone.
