SUMMARY:
 
An ordinance approving a Municipal Boundary Adjustment with the City of Live Oak releasing approximately 1.173 acres from the City of Live Oak to the City of San Antonio.  
 
 
BACKGROUND INFORMATION:
On behalf of the Royal Ridge Neighborhood Association former Councilman John Clamp initiated discussions with VIA and the City of Live Oak to relocate a VIA bus stop.  On June 25, 2013 the City of Live Oak City Council, by ordinance, requested an agreement between the City of Live Oak and the City of San Antonio which authorizes the City of Live Oak to cede certain portions of O'Connor Road and right-of-way within its city boundary to the City of San Antonio.  Under State law, Sec.43.031 of the Texas Local Government Code provides authority for adjacent municipalities to make mutually agreeable changes in their boundaries of areas that are less than 1,000 feet in width.  
 
 
ISSUE:
Currently, there are safety and location concerns regarding the VIA bus stops along this section of O'Connor Road.  The locations of the bus stops are on both sides of O'Connor Road and require pedestrians to cross into the street to avoid crossing a drainage area.  The VIA Metropolitan Transit Authority does not currently provide services to the City of Live Oak.  By ceding the roadway to the City of San Antonio, this will allow VIA Metropolitan Transit Authority to move the two bus stops on O'Connor Road thus increasing the safety of pedestrians and VIA bus riders.
 
The property is currently right-of-way and will continue to be public right-of-way.  O'Connor Road is designated as a Secondary Arterial Type A on the City of San Antonio's Major Thoroughfare Plan.  The section in question is approximately 85 feet wide and 600 feet long of right-of-way.  O'Connor Road turns into Miller Road approximately half a mile to the southeast.  Royal Ridge, Crest Ridge and two apartment complexes are located in close proximity to the subject area.  Two elementary schools and Waylon Baptist University are located within half a mile.
 
The City of Live Oak currently provides police protection/law enforcement and roadway maintenance.  Should the property be ceded to the City of San Antonio, San Antonio would provide law enforcement, emergency services, and also maintain the roadway.
 
The Annexation Policy recommends logical boundaries in order to prevent confusion between jurisdictions and provide efficient service delivery.  The property is contiguous to the City of San Antonio city limits, and its release by the City of Live Oak would extend San Antonio's city limits along the northeast limits of the right-of-way.  
 
Once the property is ceded to the City of San Antonio VIA Metropolitan Transit Authority will provide two additional bus stops along O'Connor Road thus increasing the safety of pedestrians and decreasing the distance a passenger must walk to reach a westbound bus stop.  
 
 
FISCAL IMPACT:
The subject property is within the public right-of-way and neither property nor sales taxes are collected.  The City of San Antonio will assume any future roadway costs.  Based on Transportation & Capital Improvements (TCI) staff's field evaluation this particular street does not require any immediate maintenance application.  This section of O'Connor Road has been recommended for the FY 2019 Infrastructure Management Program (IMP) for an asphalt overlay application.  The approximate overlay cost is anticipated to be $98,498.  TCI is currently developing the life cycle maintenance cost for this section of road way.
 
 
RECOMMENDATION:
Staff recommends approval of the Municipal Boundary Adjustment with the City of Live Oak.  
 
Planning Commission recommended approval of the Municipal Boundary Adjustment on July 23, 2014.
 
Infrastructure and Growth Committee recommended approval of the release on August 20, 2014.
