Contract Award: Theo Avenue & Malone Avenue Corridors
 
 
SUMMARY:
 
An ordinance for the construction of Theo Avenue and Malone Avenue Corridors, a voter approved 2012-2017 Bond-funded Project, located in Council District 5, accepting the lowest responsive bid and awarding a construction contract, in an amount not to exceed $15,095,329.00 authorized payable to Capital Excavation Co. Of this amount, $4,788,426.00 will be reimbursed by San Antonio Water Systems (SAWS) and $1,029,145.00 will be reimbursed by CPS Energy.
 
BACKGROUND INFORMATION:
 
The 2012-2017 General Obligation Bond Program authorized $14,195,000.00 for the city's share of funding for the Theo Avenue & Malone Avenue Corridors Project, and of that amount, $9,277,758.00 will be used for construction.  The balance of the Project funds approved shall be used for design services, environmental services, advertising, property acquisition and project management.
 
This Project provides for the reconstruction of approximately 1.25 miles of the one-way street Theo Avenue and 1.25 miles of the one-way street Malone Avenue from IH35 to Zarzamora, including two 11-foot travel lanes, an 8-foot parking lane, a 5 foot bicycle lane, 4-foot sidewalks, curbs, driveway approaches and drainage improvements throughout the project limits.  In addition, traffic signal upgrades will be included at the intersections of Nogalitos and Theo Avenue and Nogalitos and Malone Avenue. A community meeting was held on April 25, 2013 at the Palm Heights Park Community Center.
 
Coordination with businesses and local residents will be made during public meetings and during construction with on-site city representatives to ensure accommodations are in place to maintain accessibility during construction.  Some of those accommodations include providing temporary driveway access to residential and commercial properties and phasing the construction work to minimize traffic inconveniences to the traveling public.
 
Project construction is anticipated to begin in February 2015 and is estimated to be completed by December 2016. Construction activities will take place six days a week, sun rise to sun down.
 
 
Procurement of Services
This Project was advertised for construction bids in November 2014 in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, on TVSA and through the TCI Small Business Office. Plans also were available for review by potential bidders at the office of LNV, 8918 Tesoro Drive, Suite 401, San Antonio, Texas, 78217. Bids for this Project were opened on January 6, 2015 and three (3) bidders responded. Of these, Capital Excavation Co. submitted the lowest responsive bid. A matrix of the bid outcome is included herein as Attachment 2.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 20% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 1% African American Business Enterprise (AABE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by Capital Excavation Co. because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.
 
 
ISSUE:
 
This ordinance accepts the lowest responsive bid and awards a construction contract in an amount not to exceed $15,095,329.00, of which $4,788,426.00 will be reimbursed by SAWS and $1,029,145.00 will be reimbursed by CPS Energy, authorized payable to Capital Excavation Co., for construction of Theo Avenue & Malone Avenue Corridors, a 2012-2017 Bond-funded project, located in Council District 5.
 
This contract provides for the reconstruction of approximately 1.25 miles of Theo Avenue and 1.25 miles of Malone Avenue from IH35 to Zarzamora, including two 11-foot travel lanes, an 8-foot parking lane, a 5 foot bicycle lane, 4-foot sidewalks, curbs, driveway approaches, traffic signal and drainage improvements. Project construction is anticipated to begin in February 2015 and estimated to be completed by December 2016.

Some of those accommodations include providing temporary driveway access to residential and commercial properties and phasing the construction work to minimize traffic inconveniences to the traveling public.
 
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of this Project.
 
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in an amount not to exceed $15,095,329.00, authorized payable to Capital Excavation Co. Of this amount, $4,788,426.00 will be reimbursed by SAWS and $1,029,145.00 will be reimbursed by CPS Energy for their work. Funds are available from the 2012-2017 General Obligation Bonds and are included in the FY 2015-2020 Capital Improvement Budget.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in an amount not to exceed $15,095,329.00, authorized payable to Capital Excavation Co., for construction of Theo Avenue & Malone Avenue Corridors Project.
