SUBJECT:
 
Authorizing the assignment of a license agreement between the City of San Antonio and CPS Energy under Ordinances 2009-12-10-1033 and 93963 to Crown Castle Towers 06-2 LLC, for Fratt, Grey Forest, Hill Country, and Pearsall Rd Tower Licenses.
 
SUMMARY:
 
CPS Energy has sold and assigned the rights and interest in tower licenses being used by the City of San Antonio at 12010 Toepperwein Rd, 7439 Heuermann Rd, 18850 FM 1535, and 5287 Pearsall Rd, to Crown Castle 06-2 LLC.  This ordinance authorizes the assignment of the license agreement between the City of San Antonio and CPS Energy to Crown Castle.
 
 
BACKGROUND INFORMATION:
 
The tower sites located at 12010 Toepperwein Rd, 7439 Heuermann Rd, 18850 FM 1535, and 5287 Pearsall Rd, are an integral component of the TSSM system, an intelligent transportation system and traffic signal improvement system which maintains optimal timing plans for approximately 1,200 traffic signals throughout the city.
 
The tower sites receive traffic signal information from the traffic controllers that are transmitted across the city's private fiber network and data center to ensure traffic management and accuracy of the timing signals.
 
 
ISSUE:
 
The assignments of the Tower Licenses are not authorized under the terms of the agreement.  Approval of the assignments will ensure that this service will remain in place under the same terms and conditions as originally outlined in Ordinances 2009-12-10-1033 and 93963, but under the tower owner Crown Castle.
 
The City will compensate Crown Castle as outlined in the original ordinances and agreements.
 
 
 
 
ALTERNATIVES:
 
If the assignment of the Tower License Agreements is not approved, then Crown Castle cannot receive payment and the City will not be allowed to receive or broadcast traffic signals from these tower sites resulting in the City not being able to manage traffic signals for a large number of our traffic light poles.
 
 
FISCAL IMPACT:
 
Funding for this ordinance is available in Fund 74001000 Information Technology Services.
 
RECOMMENDATION:
 
Staff recommends approval of the License Agreement transfer.
