SUBJECT: Frio Street - Cesar Chavez to Houston Street

 

 

SUMMARY:

 

An ordinance for the Frio Street - Cesar Chavez to Houston Street Project, accepting the lowest responsive bid and awarding a construction contract in the amount of $5,149,255.61 to EZ Bel Construction LLC, a 2012-2017 General Obligation Bond-funded project, of which $463,707.21 will be reimbursed by SAWS, and $387,208.00 will be reimbursed by CPS Energy for joint-bid utility work associated with the construction of the Project, located in Council District 5.

 

 

 BACKGROUND INFORMATION:

 

The Frio Street project is funded in the 2012-2017 Bond Program and is designed to improve pedestrian and bicycle connectivity through this corridor. This project will provide wider sidewalks and improved pedestrian crossings. Raised concrete medians will be installed on Frio Street between Cesar Chavez and Buena Vista and continue again on Frio Street between Commerce and Houston. The medians will help to calm traffic. The existing roadway will not be widened but will be milled and overlayed with new asphalt pavement. The street will be re-striped to redistribute the street width to allow two lanes in each direction and 5 foot bike lanes. There are two lanes today but no bike lanes. The project limits fall within the Zona Cultural cultural district so decorative pedestrian and street lighting will be added and special landscape plantings, trees and sidewalk furniture will be placed throughout the corridor.  

 

SAWS water, sewer and CPS gas will be upgrading their infrastructure within the project limits.

 

This Project is in coordination with the Office of Historic Preservation, UTSA Downtown Campus, local business and property owners and the District 5 council office. All lane closures will be coordinated with UTSA to ensure accessibility throughout the entirety of the project.

 

 

Procurement of Services

 

This Project was advertised for construction bids in October 2016 in the San Antonio Hart Beat,

the City of San Antonio Bidding and Contracting Opportunities website, Texas Electronic State

Business Daily and on TVSA.  Bids for this Project were opened on November 15, 2016 and six (6) bidders responded. Of these, EZ Bel Construction LLC submitted the lowest responsive bid. 

 

This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 20% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 1% African American Business Enterprise (AABE) subcontracting goal and EZ Bel Construction LLC has committed to meeting both of these subcontractor goals. 

 

This construction contract was developed utilizing the low bid process; therefore, a Discretionary

Contracts Disclosure Form is not required.

 

 

ISSUE:

 

This ordinance for the Frio Street - Cesar Chavez to Houston Street Project, accepts the lowest responsive bid and awards a construction contract in the amount of $5,149,255.61 to EZ Bel Construction LLC, a 2012-2017 General Obligation Bond-funded project, of which $463,707.21 will be reimbursed by SAWS, and $387,208.00 will be reimbursed by CPS Energy for joint-bid utility work associated with the construction of the Project, located in Council District 5.

 

Construction is anticipated to begin in February 2017 and is estimated for completion by November 2017. Construction activities will take place from sunrise to sunset.

 

 

ALTERNATIVES:

 

As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.

 

 

FISCAL IMPACT:

 

This is one-time capital improvement expenditure in the amount of $5,149,255.61 authorized payable to EZ Bel Construction LLC, of which $463,707.21 will be reimbursed by SAWS, and $387,208.00 will be reimbursed by CPS Energy. Funds are available from the 2012-2017 General Obligation Bond Program for the Frio Street Project and Downtown Streets Project and are included in the FY 2017-2022 Capital Improvement Program Budget.

 

 

RECOMMENDATION:

 

Staff recommends approval of this ordinance, accepting the lowest responsive bid and awarding a construction contract in the amount of $5,149,255.61 payable to EZ Bel Construction LLC for construction of the Frio Street - Cesar Chavez to Houston Street Project.
