SUMMARY:
An ordinance for the execution of a funding agreement with San Antonio Independent School District (SAISD), in an amount not to exceed $750,000.00, for construction of storm water detention improvements as part of the Upper Woodlawn Drainage Project, a 2012 - 2017 General Obligation Bond funded project and FY 2015-2020 Storm Water Regional Facility funded project.
 
 
BACKGROUND INFORMATION:
 
Project Background
 
In May 2011, City Council approved the reallocation of approximately $47 million in Bond Program savings.  As part of this reallocation, $400,000.00 was provided for completion of a drainage study of the Upper Woodlawn Lake area watershed.  The area is bounded by Interstate Highway 10 to the north and east, Hillcrest and Bandera Road to the west and Woodlawn Lake to the south.  This area has experienced flooding over the years and several separate studies and projects have been developed to help alleviate the problem.  The study compiled all of the available studies and project information (from both Bexar County and City) to provide analysis on potential projects within the Upper Woodlawn Lake area to address flood control issues.  The two most cost effective projects based on the number of "at-risk properties" to be removed from the floodplain versus cost per property were selected: St. Cloud Storm Drain System Option 2 and the SAISD Storm Water Detention Project.
 
The SAISD Storm Water Detention project will provide flood control to the area and is located within the Thomas Jefferson high school campus.  This location was optimum for two detention basins since the school district was already making some improvements, including drainage improvements, to the site.  While the St. Cloud Storm Drain System Option 2, Upper Woodlawn Drainage Project, was funded out of the 201-2017 General Obligation Bond Program, the FY 2015-2020 Storm Water Regional Facility fund will allocate $750,000.00 upon approval of the FY 2015-2020 Capital Improvement Program Budget, for the design and construction of the detention basins.  
 
This agreement will be executed in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. As part of the agreement, immediately upon the completion of the scope of work for construction and prior to issuing bids or solicitation for any prime or subcontractors, SAISD will submit a copy of the scope of work to EDD's Small Business Office.
 
ISSUE:
 
This ordinance will authorize the execution of a funding agreement with San Antonio Independent School District, in an amount not to exceed $750,000.00, for construction of storm water detention improvements as part of the Upper Woodlawn Drainage Project.
This agreement will provide funding to be used towards drainage and flood control improvements in Upper Woodlawn Drainage area.  The drainage improvements will include the construction of two detention ponds and an underground storm drain system on the east side of the watershed at Jefferson High School. Construction is anticipated to begin in late 2014.
 
ALTERNATIVES:
As an alternative, City Council could choose not to approve this agreement, however doing so would adversely affect the timely completion of this project.
 
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount not to exceed $750,000.00, authorized payable to San Antonio Independent School District.  Funds in the amount of $750,000.00 in Storm Water Regional Facility funds will be available upon the adoption of the FY 2015-2020 Capital Improvement Program Budget.
 
RECOMMENDATION:
Staff recommends approval of this ordinance authorizing the negotiation and execution of a funding agreement in an amount not to exceed $750,000.00, payable to the San Antonio Independent School District, for construction of storm water detention improvements as part of the Upper Woodlawn Drainage Project.
