Disposition: Sale of City owned property located at 163 East Lambert Street
SUMMARY:
An ordinance declaring as surplus an unimproved 0.1086 acre tract of City owned land located at 163 East Lambert Street, and described as Lot West 43 feet of 15, Block 4, NCB 2934 in Council District 5, and authorizing its sale to Joe R. Vega for $2,437.00.
BACKGROUND INFORMATION:
Joe R. Vega (petitioner) is requesting that the City declare as surplus to its needs and sell a parcel of land located at 163 East Lambert Street as shown on attached Exhibit A. This property is identified as Lot West 43 feet of 15, Block 4, NCB 2934; it is unimproved and encompasses only 0.1086 of an acre (4,730 square feet). Over the years, the property has been maintained by the petitioner, the abutting property owner. If approved, he will combine the subject parcel with his property and enclose it as a side yard.
In accordance with City policy, the subject property was advertised to the public in the San Antonio Express News on October 25, 2013 and October 27, 2013. The petitioner was the sole bidder with a bid of $1,100. As the petitioner was the only bidder, the City has negotiated the sale of the property to the petitioner Joe R. Vega for a sum of $2,437.00.
ISSUE:
This ordinance will declare as surplus an unimproved 0.1086 acre tract of City owned land located at 163 East Lambert Street, and described as Lot West 43 feet of 15, Block 4, NCB 2934 in Council District 5, and authorize its sale to Joe R. Vega for $2,437.00.
This parcel is an unimproved parcel and encompasses only 0.1086 of an acre (4,730 square feet); it is not buildable. Over the years, the property has been maintained by the petitioner, the abutting property owner. If approved, he will combine the subject parcel with his property and enclose it as a side yard.
This action is consistent with City Code and Ordinances, which require City Council approval for the sale or disposition of City-owned or controlled real property.
ALTERNATIVES:
City Council could choose not to approve this sale; however, that would disallow the petitioner from enclosing and utilizing the property to its fullest potential. Also, the City's liability would continue along with the obligation for maintenance.
FISCAL IMPACT:
The fair market value is $7,100.00, which was established by an appraisal performed by Dugger, Canaday, Grafe, Inc. on September 27, 2013. The City of San Antonio and the petitioner have agreed on a sales price of $2,437.00, which includes administrative fees for the appraisal, advertisement and recordation. This fund will be deposited into the General Fund in accordance with FY 2014 Adopted Budget.
Also, the property will be placed on the tax rolls, which will generate revenue for the City of San Antonio as well as other taxing entities.
RECOMMENDATION:
Staff recommends approval of this ordinance to sell unimproved City-owned real property located 163 East Lambert Street in Council District 5 to Joe R. Vega.
The City of San Antonio's Planning Commission considered and approved this request at its regular meeting of May 14, 2014.
