SUBJECT:
 
An Ordinance Appointing a Replacement City Councilmember for District 1.
 
 
 
SUMMARY:
 
On Wednesday, November 12, 2014, Councilmember Diego Bernal resigned as the District 1 City Council Representative.  Said resignation became effective Tuesday, November 18, 2014.  
 
On Tuesday, November 18, 2014, the City Council approved Resolution 2014-11-18-0041R acknowledging the Resignation and Vacancy.    
 
The Office of the City Clerk accepted Applications for the Vacancy from Thursday, November 20, 2014 through 5:00 pm on Friday, December 5, 2014.  
 
At the Wednesday, December 10, 2014 "B" Session, Finalists were selected.  On Thursday, December 11, 2014 at the Regular City Council Meeting, each Finalist may be asked additional questions or make a statement before the Mayor and Council.  Citizens signed up to speak on the Appointment will be heard.  The City Council will Vote to fill the Vacancy.  With at least 8 affirmative votes, the Appointment will take effect immediately.  After being Sworn-In by the City Clerk, the new Councilmember will take a seat on the Dais.
 
The City Council may recess into Executive Session on this matter at any time.
 
The Appointee will hold office throughout the unexpired term ending May 31, 2015.  
 
 
 
BACKGROUND INFORMATION:
 
On Wednesday, November 12, 2014, Councilmember Diego Bernal resigned from his place on the City Council.  Said resignation became effective Tuesday, November 18, 2014.  
 
 
 
ISSUE:
 
The District 1 Vacancy is being filled in accordance with the provisions outlined in Section 8 of the City Charter which states that the City Council may appoint a person to serve as a Councilmember on a temporary basis.  City Ordinance 2010-05-06-0375 outlines the procedures for Appointment in the event of a Vacancy.

FISCAL IMPACT:
 
There is no fiscal impact associated with the passage of this ordinance.  
 
 
 
RECOMMENDATION:
 
The City Council will follow the procedures established for the Vacancy and make an appointment.
