SUBJECT:

 

Proposed Changes to Chapter 13 to remove Section 13-63(a)(10) prohibition of parking within 300 feet of a permitted food establishment.

 

 

SUMMARY:

 

Amending City Code Chapter 13 to remove a prohibition to parking within 300 feet of  a permitted food establishment.

 

 

BACKGROUND INFORMATION:

 

In 1983, at the request of stakeholders, a provision was added to City Code Chapter 13 which prohibited a mobile food establishment from parking within 300 feet of a permitted food establishment without obtaining a certified letter from the owner.  Based on recent input from our stakeholders, Metro Health requests that the 300 foot parking prohibition be removed from Chapter 13. 

 

 

ISSUE:

 

After obtaining feedback from stakeholders, Metro Health is recommending to amend City Code Chapter 13, Section 13-63(a)(10) to remove the 300 foot parking prohibition.

 

 

ALTERNATIVES:

 

City Council can choose to leave the code as is.

 

FISCAL IMPACT:

 

There is no fiscal impact associated with this action.

 

RECOMMENDATION:

 

Metro Health recommends amending City Code Chapter 13 to delete section 13-63(a)(10).
