Changing effective date on Ordinance No. 2019-01-10-0001 to January 14, 2019
SUMMARY:
This action changes the effective date on Ordinance No. 2019-01-10-0001 from January 20, 2019 to January 14, 2019 to facilitate full participation in City business by the District 2 Councilmember.
This action also directs City staff to review effective date criteria for public official appointment ordinances and return with recommendation.
BACKGROUND INFORMATION:
The District 2 office became vacant upon the resignation of William “Cruz” Shaw, effective January 7, 2019. After interviews of qualified applicants at the January 9, 2019 B Session and additional interviews of selected applicants at the January 10, 2019 A Session, City Council appointed Art A. Hall as the temporary Council member by a seven to three vote. As a result of that vote, the ordinance became effective ten days later, January 20, 2019 in accordance with Section 1-15 of the City Code.
To facilitate District 2 having full participation in City business prior to January 20, 2019, the effective date of the appointing ordinance needs to be moved.
ISSUE:
The effective date on Ordinance No. 2019-01-10-0001 can only be changed by City Council action.
ALTERNATIVES:
City Council could decide to not change the effective date.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
RECOMMENDATION:
Staff recommends City Council approve this item moving the effective date of Ordinance Number 2019-01-10-0001 to January 14, 2019, review effective date criteria, and return with recommendation to amend Section 1-15 of the City Code addressing the appointment of temporary members of City Council.
