SUBJECT:
Resolution to initiate rezoning of 4.406 acres out of Lots 4 and 5, Block 3, NCB 17843
 
SUMMARY:
A resolution requesting Development Services Department staff initiate a change in the zoning district boundary of 4.406 acres out of Lots 4 and 5, Block 3, NCB 17843 located on a portion of the 14400 Block of Huebner Road to a zoning district compatible with the adopted land use plan, surrounding area, and proposed development; expediting the case to City Council for consideration at the earliest possible date, and waiving all fees associated with the rezoning case.
 
BACKGROUND INFORMATION:
The wireless communication service in the vicinity of the proposed rezoning has been reported to be less than optimal.  Neighboring property owners are experiencing dropped calls and loss of data signals.  Skyway Towers, the proponent of the rezoning, has presented propagation studies to City staff indicating the necessity for a wireless communication tower located on the property to be rezoned.  Skyway Towers has indicated that a single wireless communication tower will provide the necessary and adequate service to the surrounding area.
 
ISSUE:
Rezoning the property to "C-2 S" is necessary to permit a wireless communication tower to be erected on the subject property because the wireless communication tower will be located within the Edwards Aquifer Recharge Zone.
 
ALTERNATIVES:
Denial of this resolution will result in the proposed rezoning case not being initiated by the City.
 
FISCAL IMPACT:
The total zoning case fees for the proposed zoning change are $3,518.75.  The cost of the zoning case will be absorbed by the Development Services Department.
 
RECOMMENDATION:
Staff recommends approval of the resolution.
