Settlement of Llanes v. City of San Antonio
SUMMARY:
This item authorizes a settlement of a state lawsuit styled Llanes v. City of San Antonio, Cause Number 2012-CI-20373 pending in the 224TH Judicial District Court, Bexar County, Texas for the amount of $110,000.00 to be paid out of the Self-Insurance Liability Fund.
BACKGROUND INFORMATION:
This matter involves a motor vehicle accident that occurred on May 24, 2011 at the intersection of SW Military and Commercial Street in San Antonio. At that time, a City vehicle driven by SAPD Crime Technician Edward Cruz struck the rear of a private vehicle driven by Adriana Llanes.
Ms. Llanes has incurred approximately $54,000.00 in medical expenses in the past and will incur future medical bills for additional medical treatment. She also claims lost income in the past and will continue to lose income in the future as a result of the accident.
The parties have mediated this case and reached an agreed settlement of $110,000.00 pending City Council approval.
ISSUE:
Settlements over $50,000.00 require City Council approval.
ALTERNATIVES:
If this settlement is not approved by City Council, this case will proceed to jury trial. It is in the best interest of the City to settle this matter to avoid the uncertainty and risks associated with continued litigation in a case of disputed liability.
FISCAL IMPACT:
If approved, the $110,000.00 settlement will be paid to Adriana Llanes and her attorney, Paul Campolo. This will be funded in accordance with the Adopted FY 2014 Liability Fund Budget.
RECOMMENDATION:
Staff recommends approval of this item.
