SUBJECT:

Cancellation of the Special City Election to fill the Vacancy for Council District 10 and Declaring Michael "Mike" Gallagher as the Elected Councilmember for District 10.


SUMMARY:

An Ordinance Cancelling the Special City Election to fill the Vacancy for Council District 10 and Declaring Michael "Mike" Gallagher as the Elected Councilmember for District 10.


BACKGROUND INFORMATION:

On February 6, 2014 via Ordinance 2014-02-06-0067, the City Council Ordered a Special City Election for the purpose of filling Vacancies in Council Districts 9 and 10. Pursuant to Section 201.054(a)(1) of the Texas Election Code, the time period for submitting an Application for a Place on the Ballot expired at 5:00 pm on Monday, March 10, 2014. In accordance with Section 2.052(b) of the Texas Election Code, the City Clerk provided a Certification of Unopposed Candidate to Mayor Castro on Tuesday, March 11, 2014. Said Certification provides that Michael "Mike" Gallagher is unopposed for the District 10 Vacancy.

Per Section 2.053(a) of the Texas Election Code, the City Council must declare an Ordinance Cancelling the District 10 Special Election and Declaring Michael "Mike" Gallagher duly elected.


ISSUE:

In accordance with Section 2.053 of the Texas Election Code, Michael "Mike" Gallagher is declared duly elected and shall be issued a Certificate of Election by Mayor Castro and will be administered the Oath of Office by the City Clerk at the Special Called Council Meeting scheduled for Wednesday, May 21, 2014.

FISCAL IMPACT:

The contract, excluding the cost for the Council District 10 Election, will be presented to Council when provided by the Bexar County Elections Administrator.
