Contract Award: Goliad Road Drainage Project (Southeast Military Drive to Loop 410)
 
 
SUMMARY:
 
An ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $9,794,929.10, authorized payable to Texas Sterling Construction, for construction of the Goliad Road Drainage Project (Southeast Military Drive to Loop 410), a $10.3 million voter approved 2012 - 2017 General Obligation Bond-funded Project, located in Council District 3. Of this amount, $1,015,042.00 will be reimbursed by San Antonio Water Systems (SAWS) for its work and $520,455.37 will be reimbursed by City Public Services (CPS) Energy for their work.
 
 
 
BACKGROUND INFORMATION:
 
Project Background
This Project is part of the voter approved 2012-2017 Bond Program for Drainage and Flood Control Improvements.  This Project will provide for the widening of Goliad Road, from Southeast Military Drive to Loop 410 from the current two lanes to three lanes, including two five foot bike lanes, curbs, sidewalks, driveway approaches and drainage improvements.  Project construction is anticipated to begin April 2014 and estimated to be completed by September 2015.
 
Coordination with the businesses and adjacent neighborhoods will be made to ensure accommodations are done to maintain accessibility during construction.  Some of those accommodations include: maintaining two-way traffic during the duration of the project; providing temporary driveway access to residential and commercial properties; and phasing the construction work to minimize traffic inconveniences to the traveling public.  Staff will coordinate with the contractor on options to expedite the project schedule which may require future council action.   
 
Procurement of Services
This Project was advertised for construction bids in the San Antonio Hart Beat, on the City's website and the Texas Electronic State Business Daily in January 2014. In addition, the bid announcement was made on TVSA and through the TCI Small Business Office. Plans also were available for review by potential bidders at the office of CDS Muery, located at 3411 Magic Drive, San Antonio, Texas 78229. Bids for this Project were opened on February 11, 2014 and five (5) bidders responded. Of these, Texas Sterling Construction submitted the lowest responsive bid. A matrix of the bid outcome is included herein as an attachment.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract.  The Goal Setting Committee set a 23% Small Business Enterprise (SBE) subcontracting goal and a 15% Minority/Women Business Enterprise (M/WBE) subcontracting goal.  The Economic Development Department approved a partial waiver submitted by Texas Sterling Contractors because the contractor demonstrated a good faith effort which includes SBE and M/WBE subcontractor participation of 15.7%.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
 
ISSUE:

Of this amount, $1,015,042.00 will be reimbursed by San Antonio Water Systems (SAWS) for its work and $520,455.37 will be reimbursed by City Public Services (CPS) Energy for their work.

The balance of the remaining project funds approved by voters is used for design services, environmental services, advertising, property acquisition and project management.
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of this Project.
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $9,794,929.10, authorized payable to Texas Sterling Construction. Of this amount, $1,015,042.00 will be reimbursed by San Antonio Water Systems (SAWS) for its work and $520,455.37 will be reimbursed by City Public Services (CPS) Energy for their work.
 
Funds are available from 2012 - 2017 General Obligation Bond funds and are included in the Spending Plan for the FY 2014 - 2019 Capital Improvement Program.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $9,794,929.10, authorized payable to Texas Sterling Construction, for construction of Goliad Road Drainage Project (Southeast Military Drive to Loop 410) Project.
