SUBJECT:
 
Amendments to Article III and Article VI of the Unified Development Code (UDC) relating to regulations for performing arts centers and allowing monitors to display performances in the RIO-3 District.
 
SUMMARY:
The Office of Historic Preservation is requesting amendments to Article III and Article VI of the UDC relating to regulations for performing arts centers and allowing monitors to display performances in the River Improvement Overlay (RIO)-3 District.  Monitors are currently prohibited in all RIO districts.
 
BACKGROUND INFORMATION:
 
The UDC currently prohibits digital displays or monitors in all RIO districts.  The proposed amendments would allow for institutions which meet the definition of a performing arts center to apply for a Special Use Permit from City Council to install a digital monitor wall sign in the River Walk area.  A performing arts center is defined as a multi-use performance venue with at least 1,500 permanent seats in one or more performance spaces in a building of at least one hundred thousand (100,000) square feet.  The proposed amendments will also provide regulations for such monitors to include appropriate uses, light levels, noise levels and size. The monitor may not be used for either on-premise or off-premise advertising.  It can only be used during ticketed events of the performing arts center.  
 
 
ISSUE:
 
The proposed amendments are necessary in order to distinguish certain performing arts centers as unique and contributing entities within the RIO-3 District and allow for a process in which performing arts centers seeking to display performances in the River Walk area may apply for a digital monitor that meets the minimum requirements.
 
ALTERNATIVES:
 
Recommended amendments to the UDC will not be adopted.  All monitors would continue to be prohibited in RIO-3.
 
FISCAL IMPACT:
 
There is no fiscal impact associated with this request.
 
 
RECOMMENDATION:
 
Staff recommends approval of the proposed amendments to the UDC.
