SUMMARY:
An ordinance authorizing the purchase of 11 shade structures consisting of nine canopy shade structures and two super span shade structures, from Shade Structures, Inc., in the amount of $158,022.00.  The shade structures will be installed at five parks (Acme Park, Cuellar Park, Levi Strauss Park, Mario Farias Park and West End Park) all projects funded by the 2012-2017 Bond Program located in Council Districts 1 and 6.
 
 
BACKGROUND INFORMATION:
Project Background
All Park 2012 - 2017 Bond program projects undergo a community input process which entails public meetings with the respective Council District Office, residents, Parks and Recreation Department, and Transportation and Capital Improvement Department staff.  The input received from these meetings is used to focus on the identified highest priority improvements that can be completed within the allocated project budget.  Based on the public input meetings for Acme Park, Cuellar Park, Levi Strauss Park, Mario Farias Park and West End Park, the public expressed the need of shade structures as well as other respective improvements.  Project construction of the park improvements including installation of the shade structures is anticipated to begin in December 2014 and be completed by June 2015.  
 
The purchase of the 11 shade structures consisting of nine canopy shade structures and two super span shade structures shade structures will be procured by the City's Finance Department and will be installed separately by a Job Order Contractor at the five different park locations. The Parks and Recreation Department has adopted a standard shade unit that is durable and compatible with various site conditions and park locations.  This product has demonstrated exceptional performance and has met the Parks Department's expectations in previous shade projects.
 
ISSUE:
This ordinance will authorize the fabrication and delivery of nine canopy shade structures and two super span shade structures to be installed at five different park locations (Acme Park, Cuellar Park, Levi Strauss Park, Mario Farias Park and West End Park) all projects funded by the 2012-2017 Bond Program located in Council Districts 1 and 6.  Through a cooperative purchasing agreement, Shade Structures, Inc. will fabricate and deliver the structures for installation by Job Order Contractors through separate task orders. Because the purchase of the structures are from one manufacturer, they are included on a single Purchase Order in the amount of $158,022.00.
This contract is within the scope of the SBEDA Program. However, due to lack of available firms and/or subcontracting opportunities, the Goal Setting Committee was unable to apply a SBEDA requirement to this contract.
 
This contract is an exception to the Local Preference Program.
 
ALTERNATIVES:
As an alternative, City Council could choose not to authorize this Purchase Order and require staff to implement an alternate project delivery method. Considering the additional time and expenditure to implement an alternate solicitation process this would adversely impact the budget and delay the installation of these shade structures.
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the total amount of approximately $158,022.00, for Shade Structures, Inc. Funds are available from each of the 2012-2017 General Obligation Bond Program Park Projects as follows and are included in the FY 2015-2020 Capital Improvement Budget:

RECOMMENDATION:
Staff recommends approval of this ordinance accepting the cooperatively procured offer submitted by Shade Structures, Inc., for a total cost of $158,022.00, to provide the fabrication and delivery of nine canopy shade structures and two super span shade structures for various existing recreational facilities at five park locations, located in Council Districts 1 and 6.
