Settlement of Luis Rodriguez v. City of San Antonio
 
 
SUMMARY:
 
This ordinance authorizes the settlement of a state lawsuit styled Luis Rodriguez v. City of San Antonio, Cause No. 2013-CI-03044 pending in the 224th Judicial District Court, Bexar County, Texas for payment in the amount from the Self-Insurance Liability Fund in the amount of $115,000.00.  
 
 
BACKGROUND INFORMATION:
 
This matter involves a motor vehicle accident that occurred on March 22, 2011.  At that time, the SAPD Patrol vehicle being operated by SAPD Officer Joseph Bradley struck the rear of the passenger vehicle being operated by Luis Rodriguez at the turnaround at Loop 410 at Broadway.  
 
Mr. Rodriguez claims injuries from the accident for which he has incurred medical expenses in the past and will incur medical expenses in the future for additional medical treatment.  
 
 
ISSUE:
 
Settlements over $50,000 must be approved by City Council.
 
 
ALTERNATIVES:
 
If the settlement is not approved by City Council, the case will proceed to trial.  It is in the best interest of the City to settle this matter to avoid the uncertainties and risks associated with a jury trial.
 
 
FISCAL IMPACT:
 
If approved, the $115,000 settlement will be paid to Luis Rodriguez and his attorney of record. This settlement will be funded in accordance with the current Adopted Liability Fund Budget.
 
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance.
