SUMMARY:
 
An ordinance for the construction of City-Wide Bridge Program- East Commerce Street Bridge over Salado Creek and the East Commerce Street (North Rio Grande to East Houston Street) Improvements Project, both 2012-2017 General Obligation Bond funded projects, located in Council District 2,  accepting the lowest responsive bid and awarding a construction contract to Capital Excavation, in the amount of $9,556,267.60, of which $2,872,787.70 will be reimbursed by San Antonio Water Systems (SAWS) and $174,605.20 will be reimbursed by CPS Energy, and authorizes a payment of up to $300,000 for project acceleration costs associated with additional overhead and overtime.
 
 
BACKGROUND INFORMATION:
 
The City-Wide Bridge Project is a $23.4 million, 2012 - 2017 General Obligation Bond funded project intended to replace City owned bridge structures rated as deficient, either due to compromised structural integrity, insufficient drainage capacity, or inadequate traffic provisions, or a combination. TCI initiated a bridge selection process to create a short-list of recommended bridges. This selection process entailed an evaluation of the 2011 Texas Department of Transportation (TxDOT) San Antonio District Off-System Bridge list and TxDOT's National Bridge Inventory, to help identify bridges with the greatest potential for improvement. Based on the evaluation of these lists, the E. Commerce Bridge was selected, due to its aged structure and pedestrian/bicycle access needed improvements.
 
This project replaces the bridge structure at Salado Creek, provides for a installation of a new pedestrian link from the roadway to the Salado Creek Greenway Trail and SAWS and CPS will upgrade their existing systems within the project limits.
 
The East Commerce (North Rio Grande to East Houston Street) Street Improvements Project is also a 2012-2017 Bond funded project which authorized $7,455,000.00 for improving approximately 1.5 miles of the East Commerce roadway, sidewalks, curbs, driveway approaches and drainage as appropriate between Rio Grande to Houston Street. Of the authorized amount, $3,455,261.20 will be used for construction. The balance of the Project funds approved shall be used for design services, environmental services, advertising, property acquisition and project management.
 
Both projects will run concurrently and during a portion of the construction phase, the E. Commerce Street Bridge will be closed to accommodate the bridge construction. When the bridge is closed to traffic, a detour plan will be in place to accommodate pedestrian and vehicular traffic.
 
 
PROCUREMENT OF SERVICES:
 
This joint project was advertised for construction bids in the San Antonio Hart Beat, on the City's website, through the TCI Small Business Office and the Texas Electronic State Business Daily in January 2015. Plans also were available for review by potential bidders at the office of Bain Medina Bain located at 7073 San Pedro. Bids for this Project were opened on February 10, 2015 and three (3) bidders responded. Of these, Capital Excavation submitted the lowest responsive bid. A matrix of the bid outcome is included herein.
 
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 1% African American Business Enterprise (AABE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by Capital Excavation because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.
 
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
ISSUE:
 
This ordinance for the construction of City-Wide Bridge Program- East Commerce Street Bridge over Salado Creek and the East Commerce Street (North Rio Grande to East Houston Street) Improvements Project, both 2012-2017 General Obligation Bond funded projects, located in Council District 2,  accepts the lowest responsive bid and awards a construction contract to Capital Excavation, in the amount of $9,556,267.60, of which $2,872,787.70 will be reimbursed by San Antonio Water Systems (SAWS) and $174,605.20 will be reimbursed by CPS Energy, and authorizes a payment of up to $300,000 for project acceleration costs associated with additional overhead and overtime.
 
This joint project provides improvements for the replacement of the East Commerce Street Bridge over Salado Creek, addition of sidewalks, installation of a new pedestrian link from the roadway to the Salado Creek Greenway Trail, utility improvements, and approximately 1.5 miles of roadway, curbs, driveway approaches and drainage as appropriate between Rio Grande and E. Houston Street. Project construction is anticipated to begin in April 2015 and is estimated to be completed by April 2016.
 
 
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project. Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project and funding.
 
 
 
FISCAL IMPACT:
 
This is a one-time capital improvement expenditure in the amount of $9,556,267.60, authorized payable to Capital Excavation. Of this amount, $6,508,874.70 will be funded by 2012-2017 General Obligation Bond funds of which $2,872,787.70 will be reimbursed by SAWS and $174,605.20 will be reimbursed by CPS Energy. This ordinance also authorizes a payment up to $300,000 for project acceleration costs associated with additional overhead and overtime for completing the East Commerce Street Bridge. Funds are available and are included in the FY 2015-2020 Capital Improvement Budget.

RECOMMENDATION:
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $9,556,267.60, authorized payable to Capital Excavation, for construction of the joint project City-Wide Bridge Program- E. Commerce Street Bridge and E. Commerce (N. Rio Grande to E. Houston Street) Street Improvements project and recommends that if this project is successfully accelerated, payment of an amount up to $300,000.00 be authorized payable to Capital Excavation.
