SUBJECT: Contract Award: Quail Creek Tributary Drainage
 
SUMMARY:
An ordinance for Quail Creek Tributary Drainage, a 2012-2017 Bond Program project, located in Council District 10, accepting the lowest responsive bid and awarding a construction contract to Capital Excavation Company (Capital Excavation) in amount not to exceed $2,099,290.15 of which $460,226.65 will be reimbursed by San Antonio Water Systems (SAWS) and $17,955.00 will be reimbursed by CPS Energy.
 
BACKGROUND INFORMATION:
Project Background
The 2012-2017 General Obligation Bond Program authorized $4,949,000.00 for funding of the Quail Creek Drainage Project.  The balance of the Project funds will be used for design services, environmental services, advertising and project management, with any remaining funds to be realized as bond savings.
This Project provides for improving the drainage in Quail Creek in the vicinity of Loop 410 and northward with channel and bridge improvements, which includes lowering the channel bottom and increasing the channel bottom width to keep a natural earthen channel, as well as, replacing the culvert crossing at Barrington with an open span bridge.
Public Meetings were held on June 4, 2014, at Hamilton Community Center Gym and on September 21, 2014 at the Church of Reconciliation.  Project construction is anticipated to begin April 2015 and estimated to be completed by December 2015.
Procurement of Services
An Invitation for bids was advertised in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily, and through the TCI Small Business Office in December 2014. In addition, plans were available for review by potential bidders at the office of Atkins North America, Inc., 10100 Reunion Place, Suite 850, San Antonio, Texas 78216.  Bids for this Project were opened on January 6, 2015 and four (4) bids were received.  Of these, Capital Excavation submitted the lowest responsive bid.  A matrix of the bid outcome is included herein as Attachment 2.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal and 1% African American Business Enterprise (AABE) subcontracting goal. The Economic Development Department approved a partial waiver submitted by Capital Excavation Company because the contractor demonstrated a good faith effort to provide subcontracting opportunities for small, minority, and women-owned businesses.
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
 
ISSUE:

ALTERNATIVES:
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project.  
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $2,099,290.15 authorized payable to Capital Excavation; of this amount, $460,226.65 will be reimbursed by SAWS and $17,955.00 will be reimbursed by CPS Energy. Funds are available from the 2012-2017 General Obligation Bonds and are included in the FY 2015 - 2020 Capital Improvement Budget.
