SUMMARY:
 
An ordinance for the construction of Mountain View Estates Phase III Drainage, a 2012-2017 Bond funded project, located in Council District 6, accepting the lowest responsive bid and awarding a construction contract, including two additive alternates, to R.L. Jones LP in the amount of $2,676,476.10 of which, $113,588.50 will be reimbursed by SAWS and $35,391.25 will be reimbursed by CPS Energy for their work.  This ordinance also reallocates $400,000.00 in the FY 2015 - 2020 Capital Improvement Budget in 2012-2017 General Obligation Bond funds to the Mountain View Estates Phase III Drainage Project.
 
 
BACKGROUND INFORMATION:
 
Project Background
This Project provides for the construction of an underground drainage system that ties into an existing box culvert system on Rogers Road and outfalls into a tributary of Culebra Creek. The additional funding is needed in order to complete Additive Alternates 1 and 2.  
Additive Alternate 1 would remove the existing saw tooth curbing and place a underground storm drain system with curb and sidewalk.  This would eliminate water from sheet flowing into properties adjacent to Rogers Road.
Additive Alternate 2 would remove saw tooth curbing and place curb and sidewalk.  The new curb and sidewalk would capture the remaining sheet flow water along the curb and release the water into the new storm drain constructed in Additive Alternate 1.  Combined, the additive alternates will provide a total of 1,464 linear feet of new curbs and sidewalks.
A Public Meeting was held on October 14, 2013 at the Great Northwest Homeowner's Association's Flores Hall.  Project construction is anticipated to begin April 2015 and estimated to be completed by January 2016.
Procurement of Services
An Invitation for bids was advertised in the San Antonio Hart Beat, on the City's website, on the Texas Electronic State Business Daily and through the TCI Small Business Office in January 2015. In addition, plans were available for review by potential bidders at the office of KFW Engineers & Surveying, located at 14603 Huebner Road Bldg. 40, San Antonio, Texas 78230.  Bids for this Project were opened on February 10, 2015 and seven (7) bidders responded.  Of these, R.L. Jones LP submitted the lowest responsive bid.  A matrix of the bid outcome is included herein as Attachment 2.
This contract will be awarded in compliance with the Small Business Economic Development Advocacy (SBEDA) Program, which requires contracts be reviewed by a Goal Setting Committee to establish a requirement and/or incentive unique to the particular contract in an effort to maximize the amount of small, minority, and women-owned business participation on the contract. The Goal Setting Committee set a 16% Minority/Women Business Enterprise (M/WBE) subcontracting goal and a 1% African American Business Enterprise (AABE) subcontracting goal. R.L. Jones LP has committed to 21% M/WBE and 0.7% AABE subcontractor participation.  R.L. Jones LP is also a certified small business.
This construction contract was developed utilizing the low bid process; therefore, a Discretionary Contracts Disclosure Form is not required.
 
ISSUE:
This ordinance for construction of Mountain View Estates Phase III Drainage, a 2012 Bond funded project, located in Council District 6, accepts the lowest responsive bid and awards a construction contract, including two additive alternates, to R.L. Jones LP in the amount of $2,676,476.10, of which $113,588.50 will be reimbursed by SAWS and $35,391.25 will be reimbursed by CPS Energy for their work. This ordinance also reallocates $400,000.00 in the FY 2015 - 2020 Capital Improvement Budget in 2012-2017 General Obligation Bond funds to the Mountain View Estates Phase III Drainage Project.  
This Project provides for the construction of a drainage system that ties into an underground existing box culvert system on Rogers Road and outfalls into a tributary of Culebra Creek to resolve flooding issues in the Mountain View Estates area.  Project construction is anticipated to begin April 2015 and estimated to be completed by January 2016.
ALTERNATIVES:
 
As an alternative, City Council could choose not to award this contract and require staff to re-advertise this Project.  Considering the additional time required for another solicitation process, this would adversely affect the timely completion of the Project.  
 
 
FISCAL IMPACT:
This is a one-time capital improvement expenditure in the amount of $2,676,476.10, authorized payable to R.L. Jones LP, of which $113,588.50 will be reimbursed by SAWS and $35,391.25 will be reimbursed by CPS Energy.  Funds are available from the 2012-2017 General Obligation Bonds and are included in the FY 2015 - 2020 Capital Improvement Budget. If approved by Council, additional funds in the amount of $400,000.00 in 2012-2017 General Obligation Bond funds will be reallocated in the FY 2015 - 2020 Capital Improvement Budget for this project.
 
RECOMMENDATION:
 
Staff recommends approval of this ordinance accepting the lowest responsive bid and awarding a construction contract in the amount of $2,676,476.10, authorized payable to R.L. Jones LP, for construction of Mountain View Estates Phase III Drainage; and reallocate $400,000.00 in the FY 2015 - 2020 Capital Improvement Budget in 2012-2017 General Obligation Bond funds to Mountain View Estates Phase III Drainage Project.
